55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on waste reduction and a statewide waste
88 reduction plan.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Commission" means the Texas Commission on
1212 Environmental Quality.
1313 (2) "Recycling" has the meaning assigned by Section
1414 361.421, Health and Safety Code.
1515 (3) "Waste reduction" means reducing the amount and
1616 toxicity of waste, including:
1717 (A) source reduction, as that term is defined by
1818 Section 361.421, Health and Safety Code;
1919 (B) reusing materials or diverting materials
2020 from a waste stream; and
2121 (C) recycling.
2222 SECTION 2. ADVISORY COMMITTEE; STUDY. (a) The commission
2323 shall convene an advisory committee established under Chapter 361,
2424 Health and Safety Code.
2525 (b) The commission and the advisory committee shall conduct
2626 a study regarding waste reduction in this state. The study must:
2727 (1) assess current waste reduction efforts and
2828 identify ways in which the private and public sectors can improve
2929 and increase those efforts;
3030 (2) assess the effectiveness of waste reduction
3131 statutes, regulations, and programs in this state;
3232 (3) assess the extent to which waste reduction
3333 programs in this state are duplicative;
3434 (4) investigate available funding for waste reduction
3535 programs in this state;
3636 (5) review waste reduction education programs in this
3737 state;
3838 (6) review standards in use in this state for:
3939 (A) training and certification of waste
4040 reduction professionals; and
4141 (B) reporting amounts of waste recycled;
4242 (7) review waste reduction best practices;
4343 (8) assess the economic effects of waste reduction;
4444 (9) assess job creation opportunities associated with
4545 recycling; and
4646 (10) review recycling activities in this state,
4747 including the materials being recycled and the facilities and
4848 programs that accept or use recycled materials in this state.
4949 (c) The advisory committee shall prepare a written report on
5050 the results of the study, submit the report to the commission, and
5151 collaborate with the commission to publish the study on the
5252 commission's Internet website.
5353 SECTION 3. GOAL UPDATE. The commission shall use the report
5454 described by Section 2 of this Act to reassess whether the source
5555 reduction and recycling goal established under Section 361.422,
5656 Health and Safety Code, is being achieved and how the goal might be
5757 updated.
5858 SECTION 4. PLAN UPDATES. The commission shall recommend to
5959 each entity that has adopted a solid waste management plan under
6060 Subchapter D, Chapter 363, Health and Safety Code, ways in which the
6161 entity can update the plan based on the report described by Section
6262 2 of this Act.
6363 SECTION 5. REPORT TO LEGISLATURE. Not later than December
6464 1, 2014, the commission shall submit to the lieutenant governor,
6565 the speaker of the house of representatives, and the presiding
6666 officer of the standing committee of each house of the legislature
6767 with primary jurisdiction over environmental matters a report that
6868 includes the results of the study described by Section 2 of this
6969 Act.
7070 SECTION 6. EXPIRATION. This Act expires August 31, 2015.
7171 SECTION 7. EFFECTIVE DATE. This Act takes effect
7272 immediately if it receives a vote of two-thirds of all the members
7373 elected to each house, as provided by Section 39, Article III, Texas
7474 Constitution. If this Act does not receive the vote necessary for
7575 immediate effect, this Act takes effect September 1, 2013.
