---|
7 | 7 | | relating to a study on waste reduction and a statewide waste |
---|
8 | 8 | | reduction plan. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. DEFINITIONS. In this Act: |
---|
11 | 11 | | (1) "Commission" means the Texas Commission on |
---|
12 | 12 | | Environmental Quality. |
---|
13 | 13 | | (2) "Recycling" has the meaning assigned by Section |
---|
14 | 14 | | 361.421, Health and Safety Code. |
---|
15 | 15 | | (3) "Waste reduction" means reducing the amount and |
---|
16 | 16 | | toxicity of waste, including: |
---|
17 | 17 | | (A) source reduction, as that term is defined by |
---|
18 | 18 | | Section 361.421, Health and Safety Code; |
---|
19 | 19 | | (B) reusing materials or diverting materials |
---|
20 | 20 | | from a waste stream; and |
---|
21 | 21 | | (C) recycling. |
---|
22 | 22 | | SECTION 2. ADVISORY COMMITTEE; STUDY. (a) The commission |
---|
23 | 23 | | shall convene an advisory committee established under Chapter 361, |
---|
24 | 24 | | Health and Safety Code. |
---|
25 | 25 | | (b) The commission and the advisory committee shall conduct |
---|
26 | 26 | | a study regarding waste reduction in this state. The study must: |
---|
27 | 27 | | (1) assess current waste reduction efforts and |
---|
28 | 28 | | identify ways in which the private and public sectors can improve |
---|
29 | 29 | | and increase those efforts; |
---|
30 | 30 | | (2) assess the effectiveness of waste reduction |
---|
31 | 31 | | statutes, regulations, and programs in this state; |
---|
32 | 32 | | (3) assess the extent to which waste reduction |
---|
33 | 33 | | programs in this state are duplicative; |
---|
34 | 34 | | (4) investigate available funding for waste reduction |
---|
35 | 35 | | programs in this state; |
---|
36 | 36 | | (5) review waste reduction education programs in this |
---|
37 | 37 | | state; |
---|
38 | 38 | | (6) review standards in use in this state for: |
---|
39 | 39 | | (A) training and certification of waste |
---|
40 | 40 | | reduction professionals; and |
---|
41 | 41 | | (B) reporting amounts of waste recycled; |
---|
42 | 42 | | (7) review waste reduction best practices; |
---|
43 | 43 | | (8) assess the economic effects of waste reduction; |
---|
44 | 44 | | (9) assess job creation opportunities associated with |
---|
45 | 45 | | recycling; and |
---|
46 | 46 | | (10) review recycling activities in this state, |
---|
47 | 47 | | including the materials being recycled and the facilities and |
---|
48 | 48 | | programs that accept or use recycled materials in this state. |
---|
49 | 49 | | (c) The advisory committee shall prepare a written report on |
---|
50 | 50 | | the results of the study, submit the report to the commission, and |
---|
51 | 51 | | collaborate with the commission to publish the study on the |
---|
52 | 52 | | commission's Internet website. |
---|
53 | 53 | | SECTION 3. GOAL UPDATE. The commission shall use the report |
---|
54 | 54 | | described by Section 2 of this Act to reassess whether the source |
---|
55 | 55 | | reduction and recycling goal established under Section 361.422, |
---|
56 | 56 | | Health and Safety Code, is being achieved and how the goal might be |
---|
57 | 57 | | updated. |
---|
58 | 58 | | SECTION 4. PLAN UPDATES. The commission shall recommend to |
---|
59 | 59 | | each entity that has adopted a solid waste management plan under |
---|
60 | 60 | | Subchapter D, Chapter 363, Health and Safety Code, ways in which the |
---|
61 | 61 | | entity can update the plan based on the report described by Section |
---|
62 | 62 | | 2 of this Act. |
---|
63 | 63 | | SECTION 5. REPORT TO LEGISLATURE. Not later than December |
---|
64 | 64 | | 1, 2014, the commission shall submit to the lieutenant governor, |
---|
65 | 65 | | the speaker of the house of representatives, and the presiding |
---|
66 | 66 | | officer of the standing committee of each house of the legislature |
---|
67 | 67 | | with primary jurisdiction over environmental matters a report that |
---|
68 | 68 | | includes the results of the study described by Section 2 of this |
---|
69 | 69 | | Act. |
---|
70 | 70 | | SECTION 6. EXPIRATION. This Act expires August 31, 2015. |
---|
71 | 71 | | SECTION 7. EFFECTIVE DATE. This Act takes effect |
---|
72 | 72 | | immediately if it receives a vote of two-thirds of all the members |
---|
73 | 73 | | elected to each house, as provided by Section 39, Article III, Texas |
---|
74 | 74 | | Constitution. If this Act does not receive the vote necessary for |
---|
75 | 75 | | immediate effect, this Act takes effect September 1, 2013. |
