| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 8343.004, Special District Local Laws |
|---|
| 13 | 13 | | Code, is amended to read as follows: |
|---|
| 14 | 14 | | Sec. 8343.004. CONSENT OF MUNICIPALITY REQUIRED. The |
|---|
| 15 | 15 | | temporary directors may not hold an election under Section 8343.003 |
|---|
| 16 | 16 | | until each municipality in whose corporate limits or |
|---|
| 17 | 17 | | extraterritorial jurisdiction the territory added by Section |
|---|
| 18 | 18 | | 8343.005 is located has consented by ordinance or resolution to the |
|---|
| 19 | 19 | | inclusion of land in the district. Consent of the City of San Marcos |
|---|
| 20 | 20 | | is required for the inclusion in the district of the 203.47-acre |
|---|
| 21 | 21 | | tract described in Section 2 of the Act enacting this chapter unless |
|---|
| 22 | 22 | | the district, before holding an election under Section 8343.003, |
|---|
| 23 | 23 | | excludes the 203.47-acre tract described in Section 2 of the Act |
|---|
| 24 | 24 | | enacting this chapter from the district's territory. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2013. |
