13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Subchapter A, Chapter 501, Transportation Code, |
---|
15 | 15 | | is amended by adding Section 501.007 to read as follows: |
---|
16 | 16 | | Sec. 501.007. STUDY ON FEASIBILITY OF TITLE BEING OBTAINED |
---|
17 | 17 | | FOR ALL TRAILERS, SEMITRAILERS, AND TRAVEL TRAILERS THAT ARE NOT |
---|
18 | 18 | | MANUFACTURED HOUSING. (a) The department shall conduct a study of |
---|
19 | 19 | | the feasibility of requiring title for each trailer, semitrailer, |
---|
20 | 20 | | or travel trailer that is not manufactured housing. |
---|
21 | 21 | | (b) In conducting the study required under this section, the |
---|
22 | 22 | | department must, in relation to all trailers, semitrailers, and |
---|
23 | 23 | | travel trailers covered by the study: |
---|
24 | 24 | | (1) determine the cost and feasibility of assigning |
---|
25 | 25 | | vehicle identification numbers; |
---|
26 | 26 | | (2) develop options for obtaining title; |
---|
27 | 27 | | (3) evaluate the processes of inspection, |
---|
28 | 28 | | verification, and assignment of vehicle identification numbers; |
---|
29 | 29 | | (4) develop recommendations for requiring the |
---|
30 | 30 | | permanent affixation of vehicle identification numbers; |
---|
31 | 31 | | (5) determine the approximate fiscal impact from theft |
---|
32 | 32 | | and evaluate options to decrease this theft; and |
---|
33 | 33 | | (6) evaluate the level of access individuals in rural |
---|
34 | 34 | | areas have to obtain title. |
---|
35 | 35 | | (c) In conducting the study, the department must use input |
---|
36 | 36 | | from local governmental entities that provide title services for |
---|
37 | 37 | | trailers, semitrailers, or travel trailers, automotive theft |
---|
38 | 38 | | experts, statewide associations representing agricultural |
---|
39 | 39 | | entities, and statewide associations of counties. The department |
---|
40 | 40 | | may use input from any other organization, as necessary. |
---|
41 | 41 | | (d) On request of the department, the comptroller shall |
---|
42 | 42 | | assist the department in conducting the study. |
---|
43 | 43 | | (e) The department shall prepare a report that contains its |
---|
44 | 44 | | study findings and makes recommendations regarding possible |
---|
45 | 45 | | legislative solutions to any problems found in the processes for |
---|
46 | 46 | | obtaining title for trailers, semitrailers, or travel trailers |
---|
47 | 47 | | covered by the study. Not later than September 1, 2014, the |
---|
48 | 48 | | department shall submit the report to the lieutenant governor, the |
---|
49 | 49 | | speaker of the house of representatives, and the presiding officer |
---|
50 | 50 | | of each legislative standing committee with primary jurisdiction |
---|
51 | 51 | | over motor vehicles. |
---|
52 | 52 | | (f) This section expires August 31, 2015. |
---|
53 | 53 | | SECTION 2. This Act takes effect immediately if it receives |
---|
54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 57 | | Act takes effect September 1, 2013. |
