99 AN ACT
1010 relating to a study on the feasibility of requiring title for all
1111 trailers, semitrailers, and travel trailers not considered
1212 manufactured housing.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter A, Chapter 501, Transportation Code,
1515 is amended by adding Section 501.007 to read as follows:
1616 Sec. 501.007. STUDY ON FEASIBILITY OF TITLE BEING OBTAINED
1717 FOR ALL TRAILERS, SEMITRAILERS, AND TRAVEL TRAILERS THAT ARE NOT
1818 MANUFACTURED HOUSING. (a) The department shall conduct a study of
1919 the feasibility of requiring title for each trailer, semitrailer,
2020 or travel trailer that is not manufactured housing.
2121 (b) In conducting the study required under this section, the
2222 department must, in relation to all trailers, semitrailers, and
2323 travel trailers covered by the study:
2424 (1) determine the cost and feasibility of assigning
2525 vehicle identification numbers;
2626 (2) develop options for obtaining title;
2727 (3) evaluate the processes of inspection,
2828 verification, and assignment of vehicle identification numbers;
2929 (4) develop recommendations for requiring the
3030 permanent affixation of vehicle identification numbers;
3131 (5) determine the approximate fiscal impact from theft
3232 and evaluate options to decrease this theft; and
3333 (6) evaluate the level of access individuals in rural
3434 areas have to obtain title.
3535 (c) In conducting the study, the department must use input
3636 from local governmental entities that provide title services for
3737 trailers, semitrailers, or travel trailers, automotive theft
3838 experts, statewide associations representing agricultural
3939 entities, and statewide associations of counties. The department
4040 may use input from any other organization, as necessary.
4141 (d) On request of the department, the comptroller shall
4242 assist the department in conducting the study.
4343 (e) The department shall prepare a report that contains its
4444 study findings and makes recommendations regarding possible
4545 legislative solutions to any problems found in the processes for
4646 obtaining title for trailers, semitrailers, or travel trailers
4747 covered by the study. Not later than September 1, 2014, the
4848 department shall submit the report to the lieutenant governor, the
4949 speaker of the house of representatives, and the presiding officer
5050 of each legislative standing committee with primary jurisdiction
5151 over motor vehicles.
5252 (f) This section expires August 31, 2015.
5353 SECTION 2. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2013.
