88 AN ACT
99 relating to a license suspension after moving violations for a
1010 holder of a provisional driver's license.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 521.293, Transportation Code, is amended
1313 by adding Subsections (c) and (d) to read as follows:
1414 (c) If the department determines that the person engaged in
1515 conduct described by Section 521.292(a)(8), the person does not
1616 request a hearing, and the moving violation is a third or subsequent
1717 moving violation, in addition to the suspension period required by
1818 Subsection (a), the person may not operate a motor vehicle until the
1919 91st day after the last day of the suspension period unless the
2020 person is accompanied by a person who:
2121 (1) holds a license that qualifies the person to
2222 operate that type of vehicle;
2323 (2) is 21 years of age or older; and
2424 (3) has at least one year of driving experience.
2525 (d) The department shall send notice to a parent or guardian
2626 of a person whose license is suspended under Subsection (c) of the
2727 suspension and application restrictions if the parent or guardian's
2828 address is in the records of the department.
2929 SECTION 2. The change in law made by this Act applies only
3030 to an offense described by Section 521.292(a)(8), Transportation
3131 Code, committed on or after the effective date of this Act. An
3232 offense committed before the effective date of this Act is governed
3333 by the law in effect on the date the offense was committed, and the
3434 former law is continued in effect for that purpose. For purposes of
3535 this section, an offense was committed before the effective date of
3636 this Act if any element of the offense occurred before that date.
3737 SECTION 3. This Act takes effect September 1, 2013.
