| 10 | 10 | | holder of a provisional driver's license. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 521.293, Transportation Code, is amended |
|---|
| 13 | 13 | | by adding Subsections (c) and (d) to read as follows: |
|---|
| 14 | 14 | | (c) If the department determines that the person engaged in |
|---|
| 15 | 15 | | conduct described by Section 521.292(a)(8), the person does not |
|---|
| 16 | 16 | | request a hearing, and the moving violation is a third or subsequent |
|---|
| 17 | 17 | | moving violation, in addition to the suspension period required by |
|---|
| 18 | 18 | | Subsection (a), the person may not operate a motor vehicle until the |
|---|
| 19 | 19 | | 91st day after the last day of the suspension period unless the |
|---|
| 20 | 20 | | person is accompanied by a person who: |
|---|
| 21 | 21 | | (1) holds a license that qualifies the person to |
|---|
| 22 | 22 | | operate that type of vehicle; |
|---|
| 23 | 23 | | (2) is 21 years of age or older; and |
|---|
| 24 | 24 | | (3) has at least one year of driving experience. |
|---|
| 25 | 25 | | (d) The department shall send notice to a parent or guardian |
|---|
| 26 | 26 | | of a person whose license is suspended under Subsection (c) of the |
|---|
| 27 | 27 | | suspension and application restrictions if the parent or guardian's |
|---|
| 28 | 28 | | address is in the records of the department. |
|---|
| 29 | 29 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 30 | 30 | | to an offense described by Section 521.292(a)(8), Transportation |
|---|
| 31 | 31 | | Code, committed on or after the effective date of this Act. An |
|---|
| 32 | 32 | | offense committed before the effective date of this Act is governed |
|---|
| 33 | 33 | | by the law in effect on the date the offense was committed, and the |
|---|
| 34 | 34 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 35 | 35 | | this section, an offense was committed before the effective date of |
|---|
| 36 | 36 | | this Act if any element of the offense occurred before that date. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2013. |
