9 | 9 | | relating to the provision of community-based services to |

10 | 10 | | individuals who have or may have mental illness. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. Section 534.053, Health and Safety Code, is |
---|
13 | 13 | | amended by amending Subsection (a) and adding Subsection (d) to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | (a) The department shall ensure that, at a minimum, the |
---|
16 | 16 | | following services are available in each service area: |
---|
17 | 17 | | (1) 24-hour emergency screening and rapid crisis |
---|
18 | 18 | | stabilization services; |
---|
19 | 19 | | (2) community-based crisis residential services or |
---|
20 | 20 | | hospitalization; |
---|
21 | 21 | | (3) community-based assessments, including the |
---|
22 | 22 | | development of interdisciplinary treatment plans and diagnosis and |
---|
23 | 23 | | evaluation services; |
---|
24 | 24 | | (4) family support services, including respite care; |
---|
25 | 25 | | (5) case management services; |
---|
26 | 26 | | (6) medication-related services, including medication |
---|
27 | 27 | | clinics, laboratory monitoring, medication education, mental |
---|
28 | 28 | | health maintenance education, and the provision of medication; |
---|
29 | 29 | | [and] |
---|
30 | 30 | | (7) psychosocial rehabilitation programs, including |
---|
31 | 31 | | social support activities, independent living skills, and |
---|
32 | 32 | | vocational training; and |
---|
33 | 33 | | (8) community-based alternatives to inpatient |
---|
34 | 34 | | hospitalization. |
---|
35 | 35 | | (d) Notwithstanding any other law, the department shall |
---|
36 | 36 | | ensure the availability of appropriate and timely services designed |
---|
37 | 37 | | to meet acute mental health placement needs of patients in order to |
---|
38 | 38 | | reduce a patient's acute symptoms of mental illness and to prevent a |
---|
39 | 39 | | patient's admission to an inpatient mental health facility, as |
---|
40 | 40 | | defined by Section 571.003. The available services must include at |
---|
41 | 41 | | least one of the following: |
---|
42 | 42 | | (1) crisis stabilization services; |
---|
43 | 43 | | (2) short-term residential treatment, respite care, |
---|
44 | 44 | | or extended observation services; and |
---|
45 | 45 | | (3) medical and nursing services to address the |
---|
46 | 46 | | patient's mental health condition or presenting symptoms. |
---|
47 | 47 | | SECTION 2. Subchapter B, Chapter 534, Health and Safety |
---|
48 | 48 | | Code, is amended by adding Section 534.0531 to read as follows: |
---|
49 | 49 | | Sec. 534.0531. FUNDING FOR COMMUNITY-BASED SERVICES. The |
---|
50 | 50 | | department shall provide funding for the cost of ensuring the |
---|
51 | 51 | | availability in each service area of community-based alternatives |
---|
52 | 52 | | to inpatient hospitalization to the extent those costs are not paid |
---|
53 | 53 | | from the delivery system reform incentive payments received under |
---|
54 | 54 | | the Texas Health Care Transformation and Quality Improvement |
---|
55 | 55 | | Program 1115 waiver. |
---|
56 | 56 | | SECTION 3. Section 534.054, Health and Safety Code, is |
---|
57 | 57 | | amended by adding Subsection (b) to read as follows: |
---|
58 | 58 | | (b) The department shall contract with a local mental health |
---|
59 | 59 | | authority to provide programs designed to make community-based |
---|
60 | 60 | | alternatives accessible and available in order to avert or mitigate |
---|
61 | 61 | | the need for inpatient hospitalization. |
---|
62 | 62 | | SECTION 4. If before implementing any provision of this Act |
---|
63 | 63 | | a state agency determines that a waiver or authorization from a |
---|
64 | 64 | | federal agency is necessary for implementation of that provision, |
---|
65 | 65 | | the agency affected by the provision shall request the waiver or |
---|
66 | 66 | | authorization and may delay implementing that provision until the |
---|
67 | 67 | | waiver or authorization is granted. |
---|
68 | 68 | | SECTION 5. This Act takes effect September 1, 2013. |
