77 relating to the authority of a local government to impose a civil
88 penalty for certain failures to obey a traffic-control signal.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 707.002, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 707.002. AUTHORITY TO PROVIDE FOR CIVIL PENALTY. (a)
1313 Except as provided by Subsection (b), the [The] governing body of a
1414 local authority by ordinance may implement a photographic traffic
1515 signal enforcement system and provide that the owner of a motor
1616 vehicle is liable to the local authority for a civil penalty if,
1717 while facing only a steady red signal displayed by an electrically
1818 operated traffic-control signal located in the local authority, the
1919 vehicle is operated in violation of the instructions of that
2020 traffic-control signal, as specified by Section 544.007(d).
2121 (b) An ordinance implemented by a local authority under this
2222 chapter may not impose a civil penalty on the owner of a motor
2323 vehicle that is turning right at an intersection.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2013.
