99 relating to the composition of the Texas Juvenile Justice Board.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 202.001(a), (b), and (e), Human
1212 Resources Code, are amended to read as follows:
1313 (a) The board is composed of the following nine [13] members
1414 appointed by the governor with the advice and consent of the senate:
1515 (1) one member who is a district court judge of a court
1616 designated as a juvenile court;
1717 (2) one member who is a member [three members who are
1818 members] of a county commissioners court;
1919 (3) one member who is a prosecutor in a juvenile court;
2020 (4) one member who is a chief juvenile probation
2121 officer of a juvenile probation department [serving a county with a
2222 population that includes fewer than 7,500 persons younger than 18
2323 years of age];
2424 (5) [one chief juvenile probation officer of a
2525 juvenile probation department serving a county with a population
2626 that includes at least 7,500 but fewer than 80,000 persons younger
2727 than 18 years of age;
2828 [(6) one chief juvenile probation officer of a
2929 juvenile probation department serving a county with a population
3030 that includes 80,000 or more persons younger than 18 years of age;
3131 [(7)] one adolescent mental health treatment
3232 professional licensed under Subtitle B or I, Title 3, Occupations
3333 Code;
3434 (6) [(8)] one educator, as that term is defined by
3535 Section 5.001, Education Code; and
3636 (7) [(9)] three members of the general public.
3737 (b) Members serve staggered six-year terms, with the terms
3838 of three [four or five] members expiring on February 1 of each
3939 odd-numbered year.
4040 (e) A member appointed under this section [Subsections
4141 (a)(1)-(6)] may not hold office in the same county or judicial
4242 district or reside in the same political subdivision as another
4343 member [appointed under those subsections].
4444 SECTION 2. The change in law made by Section 202.001(a),
4545 Human Resources Code, as amended by this Act, regarding the
4646 composition of members of the Texas Juvenile Justice Board does not
4747 affect the entitlement of a member serving on the board immediately
4848 before the effective date of this Act to continue to serve as a
4949 member of the board for the remainder of the member's term. On
5050 expiration of a term of a director appointed under Section
5151 202.001(a)(2), Human Resources Code, as that subdivision existed
5252 immediately before the effective date of this Act, the director's
5353 position is abolished until the number of directors appointed under
5454 that subdivision is one. On expiration of a term of a director
5555 appointed under Sections 202.001(a)(4)-(6), Human Resources Code,
5656 as those subdivisions existed immediately before the effective date
5757 of this Act, the director's position is abolished until the number
5858 of directors appointed under those subdivisions is one. As the
5959 terms of board members expire, for each position that is not
6060 abolished the governor shall appoint or reappoint a member who has
6161 the required experience until the composition of the board meets
6262 the requirements under Section 202.001(a), Human Resources Code, as
6363 amended by this Act. An initial appointment under this section to
6464 replace a director whose term expires but whose position is not
6565 abolished may be for a term of two or four years to achieve the
6666 staggering of terms under Section 202.001(b), Human Resources Code,
6767 as amended by this Act.
6868 SECTION 3. This Act takes effect September 1, 2013.
