88 AN ACT
99 relating to the confidentiality of information held by a public
1010 retirement system.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 552.0038, Government Code, is amended by
1313 adding Subsections (a-1) and (c-1) and amending Subsections (c),
1414 (d), (f), and (i) to read as follows:
1515 (a-1) For the purposes of this section, "individual record"
1616 includes any information that could reasonably be expected to
1717 identify an individual, including the individual's name, address,
1818 telephone number, e-mail address, social security number, record of
1919 membership in the public retirement system, record of contributions
2020 or distributions, account balance, status of any application for
2121 benefits, medical records, financial records, beneficiary
2222 information, and communications with the retirement system.
2323 (c) Except as provided by this section, unless written
2424 authorization for release is provided to the public retirement
2525 system by the individual or the individual's authorized
2626 representative, the following information is confidential and is
2727 not subject to public disclosure:
2828 (1) an individual record, as defined by Subsection
2929 (a-1), of any person, living or deceased, who is or was a member,
3030 annuitant, retiree, beneficiary, alternate payee, program
3131 participant, or other person eligible for benefits from a public
3232 retirement system under a retirement plan or program administered
3333 by the public retirement system that is in the custody of the
3434 retirement system or in the custody of an administering firm, a
3535 carrier, or another governmental agency, including the
3636 comptroller, acting in cooperation with or on behalf of the
3737 retirement system; and
3838 (2) any information identifying by name, address, age,
3939 date of birth, employer, dates of employment, or dates of
4040 participation the amount of a monthly allowance or benefit paid to
4141 the individual [Records of individual members, annuitants,
4242 retirees, beneficiaries, alternate payees, program participants,
4343 or persons eligible for benefits from a retirement system under a
4444 retirement plan or program administered by the retirement system
4545 that are in the custody of the system or in the custody of an
4646 administering firm, a carrier, or another governmental agency,
4747 including the comptroller, acting in cooperation with or on behalf
4848 of the retirement system are confidential and not subject to public
4949 disclosure].
5050 (c-1) Except as otherwise provided by this section, the
5151 public [The] retirement system, administering firm, carrier, or
5252 governmental agency is not required to accept or comply with a
5353 request for [a record or] information determined to be confidential
5454 under Subsection (c). This section should not be interpreted as
5555 preventing disclosure of aggregate information that could not
5656 reasonably be expected to identify an individual. An entity that
5757 receives a request for the disclosure of information under this
5858 section should consider the request in context with other publicly
5959 available information in making the determination as to whether a
6060 record could reasonably be expected to identify an individual
6161 [about a record or to seek an opinion from the attorney general
6262 because the records are exempt from the provisions of this chapter,
6363 except as otherwise provided by this section].
6464 (d) A public retirement system may release individual
6565 records, in accordance with the provisions of the statute or
6666 ordinance establishing the system and the rules or policies of the
6767 system, to the following entities:
6868 (1) [Records may be released to] a member, annuitant,
6969 retiree, beneficiary, alternate payee, program participant, or
7070 person eligible for benefits from the retirement system;
7171 (2) [or to] an authorized attorney, family member, or
7272 representative acting on behalf of the member, annuitant, retiree,
7373 beneficiary, alternate payee, program participant, or person
7474 eligible for benefits;
7575 (3) [. The retirement system may release the records
7676 to:
7777 [(1)] an administering firm, carrier, or agent or
7878 attorney acting on behalf of the retirement system;
7979 (4) [(2)] another governmental entity having a
8080 legitimate need for the information to perform the purposes of the
8181 retirement system; or
8282 (5) [(3)] a party in response to a subpoena issued
8383 under applicable law.
8484 (f) The records of an individual member, annuitant,
8585 retiree, beneficiary, alternate payee, program participant, or
8686 person eligible for benefits from the retirement system remain
8787 confidential after release to an individual or entity [a person] as
8888 authorized by this section. The records may become part of the
8989 public record of an administrative or judicial proceeding related
9090 to a contested case, and the member, annuitant, retiree,
9191 beneficiary, alternate payee, program participant, or person
9292 eligible for benefits waives the confidentiality of the records,
9393 including medical records, unless the records are closed to public
9494 access by a protective order issued under applicable law.
9595 (i) To the extent of a substantive or procedural conflict
9696 between this section and any other law with respect to the
9797 confidential information held by a public retirement system or
9898 other entity described by Subsection (c) concerning an individual
9999 member, annuitant, retiree, beneficiary, alternate payee, program
100100 participant, or person eligible for benefits from the retirement
101101 system:
102102 (1) [,] the substantive [prevailing] provision [is the
103103 provision] that provides the greater [substantive and procedural]
104104 protection for the privacy of information concerning that
105105 individual member, annuitant, retiree, beneficiary, alternate
106106 payee, program participant, or person eligible for benefits
107107 prevails; and
108108 (2) the procedural provision of this chapter prevails.
109109 SECTION 2. Section 552.0038(h), Government Code, is
110110 repealed.
111111 SECTION 3. Section 552.0038, Government Code, as amended by
112112 this Act, applies only to a request for information received by a
113113 public retirement system or other entity described by Subsection
114114 (c) of that section that is received on or after the effective date
115115 of this Act. A request for information that is received before the
116116 effective date of this Act is governed by the law in effect on the
117117 date the request is received, and that law is continued in effect
118118 for that purpose.
119119 SECTION 4. This Act takes effect immediately if it receives
120120 a vote of two-thirds of all the members elected to each house, as
121121 provided by Section 39, Article III, Texas Constitution. If this
122122 Act does not receive the vote necessary for immediate effect, this
123123 Act takes effect September 1, 2013.
