| 8 | 8 | | animal from required disclosure under the public information law. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 552, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 552.1177 to read as follows: |
|---|
| 12 | 12 | | Sec. 552.1177. CONFIDENTIALITY OF CERTAIN INFORMATION |
|---|
| 13 | 13 | | RELATED TO THE HUMAN DISPOSITION OF AN UNCLAIMED STRAY ANIMAL. (a) |
|---|
| 14 | 14 | | Except as provided by Subsection (b), information is confidential |
|---|
| 15 | 15 | | and excepted from the requirements of Section 552.021 if it is |
|---|
| 16 | 16 | | information that relates to the name, address, telephone number, |
|---|
| 17 | 17 | | electronic mail address, drivers license number, social security |
|---|
| 18 | 18 | | number, or other personally identifying information of a person who |
|---|
| 19 | 19 | | obtains ownership or control of an unclaimed stray animal from a |
|---|
| 20 | 20 | | local government making a humane disposition of the animal under |
|---|
| 21 | 21 | | Section 826.033, Health and Safety Code. |
|---|
| 22 | 22 | | (b) The information may be disclosed only to a governmental |
|---|
| 23 | 23 | | entity or a person that, under a contract with a governmental |
|---|
| 24 | 24 | | entity, provides animal control services, animal registration |
|---|
| 25 | 25 | | services, or related services for the governmental entity for |
|---|
| 26 | 26 | | purposes related to the protection of public health and safety. A |
|---|
| 27 | 27 | | governmental entity or person that receives the information must |
|---|
| 28 | 28 | | maintain the confidentiality of the information, may not disclose |
|---|
| 29 | 29 | | the information under this chapter and may not use the information |
|---|
| 30 | 30 | | for a purpose that does not directly relate to the protection of |
|---|
| 31 | 31 | | public health and safety. |
|---|
| 32 | 32 | | SECTION 2. The change in law made by this Act applies to |
|---|
| 33 | 33 | | information related to the humane disposition by a local government |
|---|
| 34 | 34 | | of an unclaimed stray animal created before, on, or after the |
|---|
| 35 | 35 | | effective date of this Act. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2013. |
