55 AN ACT
66 relating to the exception of certain information related to the
77 humane disposition by a local government of an unclaimed stray
88 animal from required disclosure under the public information law.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1111 amended by adding Section 552.1177 to read as follows:
1212 Sec. 552.1177. CONFIDENTIALITY OF CERTAIN INFORMATION
1313 RELATED TO THE HUMAN DISPOSITION OF AN UNCLAIMED STRAY ANIMAL. (a)
1414 Except as provided by Subsection (b), information is confidential
1515 and excepted from the requirements of Section 552.021 if it is
1616 information that relates to the name, address, telephone number,
1717 electronic mail address, drivers license number, social security
1818 number, or other personally identifying information of a person who
1919 obtains ownership or control of an unclaimed stray animal from a
2020 local government making a humane disposition of the animal under
2121 Section 826.033, Health and Safety Code.
2222 (b) The information may be disclosed only to a governmental
2323 entity or a person that, under a contract with a governmental
2424 entity, provides animal control services, animal registration
2525 services, or related services for the governmental entity for
2626 purposes related to the protection of public health and safety. A
2727 governmental entity or person that receives the information must
2828 maintain the confidentiality of the information, may not disclose
2929 the information under this chapter and may not use the information
3030 for a purpose that does not directly relate to the protection of
3131 public health and safety.
3232 SECTION 2. The change in law made by this Act applies to
3333 information related to the humane disposition by a local government
3434 of an unclaimed stray animal created before, on, or after the
3535 effective date of this Act.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2013.
