99 AN ACT
1010 relating to taxes and bonds for a junior college district branch
1111 campus.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter E, Chapter 130, Education Code, is
1414 amended by adding Section 130.0865 to read as follows:
1515 Sec. 130.0865. SECURITY FOR REVENUE BONDS ISSUED FOR BRANCH
1616 CAMPUS, CENTER, OR EXTENSION FACILITY. Bonds payable from revenue
1717 and issued by the governing body of a county or school district to
1818 finance the purchase of land or the construction of a facility to be
1919 used for a branch campus, center, or extension facility authorized
2020 under Section 130.086 may be secured by a trust indenture, a deed of
2121 trust, or a mortgage granting a security interest in the applicable
2222 land or facility.
2323 SECTION 2. Section 130.087(k), Education Code, is amended
2424 to read as follows:
2525 (k) The proceeds of the junior college district branch
2626 campus maintenance tax may be used only as follows:
2727 (1) to operate and maintain a junior college district
2828 branch campus and [to] support its programs and services in the area
2929 of the political subdivision [a jurisdiction] that levied the
3030 [levies a junior college district branch campus maintenance] tax;
3131 and
3232 (2) under an agreement by the applicable junior
3333 college district and the political subdivision levying the tax, to
3434 make lease payments to the political subdivision for facilities
3535 used exclusively by the branch campus that are owned by the
3636 political subdivision [to operate, maintain, and support the same
3737 junior college district branch campus].
3838 SECTION 3. (a) The change in law made by this Act in adding
3939 Section 130.0865, Education Code, applies only to a bond issued on
4040 or after the effective date of this Act. A bond issued before the
4141 effective date of this Act is governed by the law in effect at the
4242 time the bond was issued, and the former law is continued in effect
4343 for that purpose.
4444 (b) The change in law made by this Act in amending Section
4545 130.087, Education Code, applies to the proceeds of a junior
4646 college district branch campus maintenance tax levied under Section
4747 130.087, Education Code, without regard to whether imposition of
4848 the tax was approved by the voters or the proceeds were derived from
4949 taxes imposed before, on, or after the effective date of this Act.
5050 SECTION 4. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2013.
