10	10	relating to taxes and bonds for a junior college district branch
11	11	campus.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subchapter E, Chapter 130, Education Code, is
14	14	amended by adding Section 130.0865 to read as follows:
15	15	Sec. 130.0865. SECURITY FOR REVENUE BONDS ISSUED FOR BRANCH
16	16	CAMPUS, CENTER, OR EXTENSION FACILITY. Bonds payable from revenue
17	17	and issued by the governing body of a county or school district to
18	18	finance the purchase of land or the construction of a facility to be
19	19	used for a branch campus, center, or extension facility authorized
20	20	under Section 130.086 may be secured by a trust indenture, a deed of
21	21	trust, or a mortgage granting a security interest in the applicable
22	22	land or facility.
23	23	SECTION 2. Section 130.087(k), Education Code, is amended
24	24	to read as follows:
25	25	(k) The proceeds of the junior college district branch
26	26	campus maintenance tax may be used only as follows:
27	27	(1) to operate and maintain a junior college district
28	28	branch campus and [to] support its programs and services in the area
29	29	of the political subdivision [a jurisdiction] that levied the
30	30	[levies a junior college district branch campus maintenance] tax;
31	31	and
32	32	(2) under an agreement by the applicable junior
33	33	college district and the political subdivision levying the tax, to
34	34	make lease payments to the political subdivision for facilities
35	35	used exclusively by the branch campus that are owned by the
36	36	political subdivision [to operate, maintain, and support the same
37	37	junior college district branch campus].
38	38	SECTION 3. (a) The change in law made by this Act in adding
39	39	Section 130.0865, Education Code, applies only to a bond issued on
40	40	or after the effective date of this Act. A bond issued before the
41	41	effective date of this Act is governed by the law in effect at the
42	42	time the bond was issued, and the former law is continued in effect
43	43	for that purpose.
44	44	(b) The change in law made by this Act in amending Section
45	45	130.087, Education Code, applies to the proceeds of a junior
46	46	college district branch campus maintenance tax levied under Section
47	47	130.087, Education Code, without regard to whether imposition of
48	48	the tax was approved by the voters or the proceeds were derived from
49	49	taxes imposed before, on, or after the effective date of this Act.
50	50	SECTION 4. This Act takes effect immediately if it receives
51	51	a vote of two-thirds of all the members elected to each house, as
52	52	provided by Section 39, Article III, Texas Constitution. If this
53	53	Act does not receive the vote necessary for immediate effect, this
54	54	Act takes effect September 1, 2013.
