 A BILL TO BE ENTITLED
 AN ACT
 relating to the authority of the Department of Public Safety to
 allow blood pressure machines to be located in driver's license
 offices.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 411, Government Code, is amended by
 adding Subchapter P to read as follows:
 SUBCHAPTER P.  AVAILABILITY OF BLOOD PRESSURE MACHINES
 IN DRIVER'S LICENSE OFFICES
 Sec. 411.441.  DEFINITIONS. In this subchapter:
 (1)  "Blood pressure machine" means a device that
 measures a person's blood pressure and displays the person's blood
 pressure reading.
 (2)  "Driver's license" has the meaning assigned by
 Section 521.001, Transportation Code.
 Sec. 411.442.  BLOOD PRESSURE MACHINE. (a) The department
 may allow a blood pressure machine to be located in an office
 authorized to issue driver's licenses in this state.
 (b)  A blood pressure machine described by Subsection (a):
 (1)  must be made available at no cost to the state; and
 (2)  may not display an advertisement.
 (c)  The department may not:
 (1)  require an applicant for a driver's license to
 obtain a blood pressure reading from a blood pressure machine
 described by Subsection (a) as a condition of being issued a
 driver's license; or
 (2)  charge a fee to obtain a blood pressure reading
 from a blood pressure machine described by Subsection (a).
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2013.
