99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the business leave time account for a police officer
1212 employee organization in certain municipalities.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 142.013(d), Local Government Code, is
1515 amended to read as follows:
1616 (d) Donations to the business leave time account of an
1717 employee organization by its members may be authorized in one of the
1818 following ways:
1919 (1) if the majority of the membership of the employee
2020 organization has not affirmatively voted to require contributions
2121 by the employee organization's members to its business leave time
2222 account:
2323 (A) a [The] police officer must authorize the
2424 donation in writing on a form provided by the employee organization
2525 and approved by the municipality; and
2626 (B) after[. After] receiving the signed
2727 authorization on an approved form, the municipality shall transfer
2828 donated time to the account monthly until the municipality receives
2929 the police officer's written revocation of the authorization; or
3030 (2) if the majority of the membership of the employee
3131 organization has affirmatively voted to require contributions by
3232 the employee organization's members to its business leave time
3333 account:
3434 (A) except as provided by Paragraph (C), the
3535 municipality shall transfer donated time to the employee
3636 organization's business leave time account from the accumulated
3737 vacation or compensatory time of each police officer who is a member
3838 of the employee organization in the amount approved by vote of the
3939 employee organization not to exceed the amount allowed under
4040 Subsection (c);
4141 (B) the municipality shall transfer the donated
4242 time to the account monthly beginning with the first calendar month
4343 that begins after the date of the employee organization vote
4444 requiring contributions; and
4545 (C) each year, during the period beginning on the
4646 60th day before the anniversary of the first day of the first
4747 calendar month in which donations were first transferred to the
4848 business leave time account of the employee organization under
4949 Paragraph (B) and ending on the 30th day before that anniversary, a
5050 police officer who is a member of the employee organization may
5151 inform the municipality in writing on a form provided by the
5252 employee organization and approved by the municipality that the
5353 police officer chooses to not donate time to the account during the
5454 12-month period beginning with that anniversary.
5555 SECTION 2. Section 142.013(i), Local Government Code, is
5656 repealed.
5757 SECTION 3. This Act takes effect September 1, 2013.
