11	11	relating to the business leave time account for a police officer
12	12	employee organization in certain municipalities.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. Section 142.013(d), Local Government Code, is
15	15	amended to read as follows:
16	16	(d) Donations to the business leave time account of an
17	17	employee organization by its members may be authorized in one of the
18	18	following ways:
19	19	(1) if the majority of the membership of the employee
20	20	organization has not affirmatively voted to require contributions
21	21	by the employee organization's members to its business leave time
22	22	account:
23	23	(A) a [The] police officer must authorize the
24	24	donation in writing on a form provided by the employee organization
25	25	and approved by the municipality; and
26	26	(B) after[. After] receiving the signed
27	27	authorization on an approved form, the municipality shall transfer
28	28	donated time to the account monthly until the municipality receives
29	29	the police officer's written revocation of the authorization; or
30	30	(2) if the majority of the membership of the employee
31	31	organization has affirmatively voted to require contributions by
32	32	the employee organization's members to its business leave time
33	33	account:
34	34	(A) except as provided by Paragraph (C), the
35	35	municipality shall transfer donated time to the employee
36	36	organization's business leave time account from the accumulated
37	37	vacation or compensatory time of each police officer who is a member
38	38	of the employee organization in the amount approved by vote of the
39	39	employee organization not to exceed the amount allowed under
40	40	Subsection (c);
41	41	(B) the municipality shall transfer the donated
42	42	time to the account monthly beginning with the first calendar month
43	43	that begins after the date of the employee organization vote
44	44	requiring contributions; and
45	45	(C) each year, during the period beginning on the
46	46	60th day before the anniversary of the first day of the first
47	47	calendar month in which donations were first transferred to the
48	48	business leave time account of the employee organization under
49	49	Paragraph (B) and ending on the 30th day before that anniversary, a
50	50	police officer who is a member of the employee organization may
51	51	inform the municipality in writing on a form provided by the
52	52	employee organization and approved by the municipality that the
53	53	police officer chooses to not donate time to the account during the
54	54	12-month period beginning with that anniversary.
55	55	SECTION 2. Section 142.013(i), Local Government Code, is
56	56	repealed.
57	57	SECTION 3. This Act takes effect September 1, 2013.
