99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the disclosure of certain information to the secretary
1212 of state for use in voter registration or the administration of
1313 elections.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Sections 521.044(a) and (c), Transportation
1616 Code, are amended to read as follows:
1717 (a) Information provided on a driver's license application
1818 that relates to the applicant's social security number may be used
1919 only by the department or disclosed only to:
2020 (1) the child support enforcement division of the
2121 attorney general's office;
2222 (2) another state entity responsible for enforcing the
2323 payment of child support;
2424 (3) the United States Selective Service System as
2525 provided by Section 521.147; [or]
2626 (4) the unclaimed property division of the
2727 comptroller's office; or
2828 (5) the secretary of state for the purposes of voter
2929 registration or the administration of elections.
3030 (c) On the request of a state entity responsible for
3131 investigating or enforcing the payment of child support or the
3232 secretary of state, the department shall disclose information
3333 regarding an applicant's social security number.
3434 SECTION 2. Section 730.005, Transportation Code, is amended
3535 to read as follows:
3636 Sec. 730.005. REQUIRED DISCLOSURE. Personal information
3737 obtained by an agency in connection with a motor vehicle record
3838 shall be disclosed for use in connection with any matter of:
3939 (1) motor vehicle or motor vehicle operator safety;
4040 (2) motor vehicle theft;
4141 (3) motor vehicle emissions;
4242 (4) motor vehicle product alterations, recalls, or
4343 advisories;
4444 (5) performance monitoring of motor vehicles or motor
4545 vehicle dealers by a motor vehicle manufacturer;
4646 (6) removal of nonowner records from the original
4747 owner records of a motor vehicle manufacturer to carry out the
4848 purposes of:
4949 (A) the Automobile Information Disclosure Act,
5050 15 U.S.C. Section 1231 et seq.;
5151 (B) 49 U.S.C. Chapters 301, 305, 323, 325, 327,
5252 329, and 331;
5353 (C) the Anti Car Theft Act of 1992, 18 U.S.C.
5454 Sections 553, 981, 982, 2119, 2312, 2313, and 2322, 19 U.S.C.
5555 Sections 1646b and 1646c, and 42 U.S.C. Section 3750a et seq., all
5656 as amended;
5757 (D) the Clean Air Act, 42 U.S.C. Section 7401 et
5858 seq., as amended; and
5959 (E) any other statute or regulation enacted or
6060 adopted under or in relation to a law included in Paragraphs
6161 (A)-(D);
6262 (7) child support enforcement under Chapter 231,
6363 Family Code; [or]
6464 (8) enforcement by the Texas Workforce Commission
6565 under Title 4, Labor Code; or
6666 (9) voter registration or the administration of
6767 elections by the secretary of state.
6868 SECTION 3. This Act takes effect immediately if it receives
6969 a vote of two-thirds of all the members elected to each house, as
7070 provided by Section 39, Article III, Texas Constitution. If this
7171 Act does not receive the vote necessary for immediate effect, this
7272 Act takes effect September 1, 2013.
