 A BILL TO BE ENTITLED
 AN ACT
 relating to certain fees charged for adjudication of claims under
 health benefit plans.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 1213.005, Insurance Code, is amended to
 read as follows:
 Sec. 1213.005.  CERTAIN CHARGES PROHIBITED. A health
 benefit plan or a third-party administrator or pharmacy benefit
 manager acting on behalf of the health benefit plan may not directly
 or indirectly charge or hold a health care professional, health
 care facility, or person enrolled in a health benefit plan
 responsible for a fee for the adjudication of a claim.
 SECTION 2.  This Act applies only to a claim submitted on or
 after September 1, 2013. A claim submitted before September 1,
 2013, is governed by the law as it existed immediately before that
 date, and that law is continued in effect for that purpose.
 SECTION 3.  This Act takes effect September 1, 2013.
