| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 452.541, Transportation Code, is amended |
|---|
| 14 | 14 | | to read as follows: |
|---|
| 15 | 15 | | Sec. 452.541. BOARD MEMBERSHIP: RESIDENCY IN AUTHORITY. |
|---|
| 16 | 16 | | (a) Except as provided by Subsection (b), a [A] member of a |
|---|
| 17 | 17 | | subregional board must be a qualified voter residing in the |
|---|
| 18 | 18 | | authority. |
|---|
| 19 | 19 | | (b) An individual who does not reside in the authority may |
|---|
| 20 | 20 | | be appointed to the board under Section 452.562(c)(1) if the |
|---|
| 21 | 21 | | individual is a qualified voter of and resides in a municipality |
|---|
| 22 | 22 | | that: |
|---|
| 23 | 23 | | (1) has entered into a contract with the authority to |
|---|
| 24 | 24 | | receive services; and |
|---|
| 25 | 25 | | (2) has adopted a sales tax to participate in the |
|---|
| 26 | 26 | | funding of a transportation project being planned, developed, or |
|---|
| 27 | 27 | | operated by the authority. |

| 28 | 28 | | SECTION 2. Section 452.562, Transportation Code, is amended |
|---|
| 29 | 29 | | by amending Subsection (c) and adding Subsection (g) to read as |
|---|
| 30 | 30 | | follows: |
|---|
| 31 | 31 | | (c) If Subsection (b) does not apply, the subregional board |
|---|
| 32 | 32 | | shall be appointed as follows: |
|---|
| 33 | 33 | | (1) the commissioners court of the county of the |
|---|
| 34 | 34 | | principal municipality shall appoint at least one member to |
|---|
| 35 | 35 | | represent: |
|---|
| 36 | 36 | | (A) the unincorporated areas and municipalities |
|---|
| 37 | 37 | | in the county that are not otherwise represented on the subregional |
|---|
| 38 | 38 | | board; and |
|---|
| 39 | 39 | | (B) the municipalities that have entered into a |
|---|
| 40 | 40 | | contract with the authority to receive services; and |
|---|
| 41 | 41 | | (2) the remaining members shall be apportioned to the |
|---|
| 42 | 42 | | municipalities confirmed as all or part of the subregion according |
|---|
| 43 | 43 | | to the ratio that the population of each unit of election bears to |
|---|
| 44 | 44 | | the total population of the area confirmed as the subregion. |
|---|
| 45 | 45 | | (g) An elected officer of the state or a political |
|---|
| 46 | 46 | | subdivision of this state who is not prohibited by the Texas |
|---|
| 47 | 47 | | Constitution from serving on the board is eligible, as an |
|---|
| 48 | 48 | | additional duty of office, to serve on the board. An elected |
|---|
| 49 | 49 | | officer who is a board member is not entitled to receive |
|---|
| 50 | 50 | | compensation for serving as a member but is entitled to |
|---|
| 51 | 51 | | reimbursement for reasonable expenses incurred in performing |
|---|
| 52 | 52 | | duties as a member. |
|---|
| 53 | 53 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 57 | 57 | | Act takes effect September 1, 2013. |
