99 AN ACT
1010 relating to the composition of certain regional transportation
1111 authority subregional boards.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 452.541, Transportation Code, is amended
1414 to read as follows:
1515 Sec. 452.541. BOARD MEMBERSHIP: RESIDENCY IN AUTHORITY.
1616 (a) Except as provided by Subsection (b), a [A] member of a
1717 subregional board must be a qualified voter residing in the
1818 authority.
1919 (b) An individual who does not reside in the authority may
2020 be appointed to the board under Section 452.562(c)(1) if the
2121 individual is a qualified voter of and resides in a municipality
2222 that:
2323 (1) has entered into a contract with the authority to
2424 receive services; and
2525 (2) has adopted a sales tax to participate in the
2626 funding of a transportation project being planned, developed, or
2727 operated by the authority.
2828 SECTION 2. Section 452.562, Transportation Code, is amended
2929 by amending Subsection (c) and adding Subsection (g) to read as
3030 follows:
3131 (c) If Subsection (b) does not apply, the subregional board
3232 shall be appointed as follows:
3333 (1) the commissioners court of the county of the
3434 principal municipality shall appoint at least one member to
3535 represent:
3636 (A) the unincorporated areas and municipalities
3737 in the county that are not otherwise represented on the subregional
3838 board; and
3939 (B) the municipalities that have entered into a
4040 contract with the authority to receive services; and
4141 (2) the remaining members shall be apportioned to the
4242 municipalities confirmed as all or part of the subregion according
4343 to the ratio that the population of each unit of election bears to
4444 the total population of the area confirmed as the subregion.
4545 (g) An elected officer of the state or a political
4646 subdivision of this state who is not prohibited by the Texas
4747 Constitution from serving on the board is eligible, as an
4848 additional duty of office, to serve on the board. An elected
4949 officer who is a board member is not entitled to receive
5050 compensation for serving as a member but is entitled to
5151 reimbursement for reasonable expenses incurred in performing
5252 duties as a member.
5353 SECTION 3. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2013.
