8	8	AN ACT
9	9	relating to disease management practices of local mental health
10	10	authorities.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 533.0354, Health and Safety Code, is
13	13	amended by amending Subsections (a) and (b) and adding Subsection
14	14	(a-1) to read as follows:
15	15	(a) A local mental health authority shall ensure the
16	16	provision of assessment services, crisis services, and intensive
17	17	and comprehensive services using disease management practices for
18	18	children with serious emotional, behavioral, or mental disturbance
19	19	and adults with severe mental illness who are experiencing
20	20	significant functional impairment due to a mental health disorder
21	21	defined by the Diagnostic and Statistical Manual of Mental
22	22	Disorders, 5th Edition (DSM-5), including:
23	23	(1) bipolar disorder;
24	24	(2) [,] schizophrenia;
25	25	(3) major depressive disorder, including single
26	26	episode or recurrent major depressive disorder;
27	27	(4) post-traumatic stress disorder;
28	28	(5) schizoaffective disorder, including bipolar and
29	29	depressive types;
30	30	(6) obsessive compulsive disorder;
31	31	(7) anxiety disorder;
32	32	(8) attention deficit disorder;
33	33	(9) delusional disorder;
34	34	(10) bulimia nervosa, anorexia nervosa, or other
35	35	eating disorders not otherwise specified; or
36	36	(11) any other diagnosed mental health disorder [, or
37	37	clinically severe depression and for children with serious
38	38	emotional illnesses].
39	39	(a-1) The local mental health authority shall ensure that
40	40	individuals are engaged with treatment services that are:
41	41	(1) ongoing and matched to the needs of the individual
42	42	in type, duration, and intensity;
43	43	(2) focused on a process of recovery designed to allow
44	44	the individual to progress through levels of service;
45	45	(3) guided by evidence-based protocols and a
46	46	strength-based paradigm of service; and
47	47	(4) monitored by a system that holds the local
48	48	authority accountable for specific outcomes, while allowing
49	49	flexibility to maximize local resources.
50	50	(b) The department shall require each local mental health
51	51	authority to incorporate jail diversion strategies into the
52	52	authority's disease management practices to reduce the involvement
53	53	of the criminal justice system in [for] managing adults with the
54	54	following disorders as defined by the Diagnostic and Statistical
55	55	Manual of Mental Disorders, 5th Edition (DSM-5):
56	56	(1) schizophrenia;
57	57	(2) [and] bipolar disorder;
58	58	(3) post-traumatic stress disorder;
59	59	(4) schizoaffective disorder, including bipolar and
60	60	depressive types;
61	61	(5) anxiety disorder; or
62	62	(6) delusional disorder [to reduce the involvement of
63	63	those client populations with the criminal justice system].
64	64	SECTION 2. This Act takes effect January 1, 2014.
