99 relating to disease management practices of local mental health
1010 authorities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 533.0354, Health and Safety Code, is
1313 amended by amending Subsections (a) and (b) and adding Subsection
1414 (a-1) to read as follows:
1515 (a) A local mental health authority shall ensure the
1616 provision of assessment services, crisis services, and intensive
1717 and comprehensive services using disease management practices for
1818 children with serious emotional, behavioral, or mental disturbance
1919 and adults with severe mental illness who are experiencing
2020 significant functional impairment due to a mental health disorder
2121 defined by the Diagnostic and Statistical Manual of Mental
2222 Disorders, 5th Edition (DSM-5), including:
2323 (1) bipolar disorder;
2424 (2) [,] schizophrenia;
2525 (3) major depressive disorder, including single
2626 episode or recurrent major depressive disorder;
2727 (4) post-traumatic stress disorder;
2828 (5) schizoaffective disorder, including bipolar and
2929 depressive types;
3030 (6) obsessive compulsive disorder;
3131 (7) anxiety disorder;
3232 (8) attention deficit disorder;
3333 (9) delusional disorder;
3434 (10) bulimia nervosa, anorexia nervosa, or other
3535 eating disorders not otherwise specified; or
3636 (11) any other diagnosed mental health disorder [, or
3737 clinically severe depression and for children with serious
3838 emotional illnesses].
3939 (a-1) The local mental health authority shall ensure that
4040 individuals are engaged with treatment services that are:
4141 (1) ongoing and matched to the needs of the individual
4242 in type, duration, and intensity;
4343 (2) focused on a process of recovery designed to allow
4444 the individual to progress through levels of service;
4545 (3) guided by evidence-based protocols and a
4646 strength-based paradigm of service; and
4747 (4) monitored by a system that holds the local
4848 authority accountable for specific outcomes, while allowing
4949 flexibility to maximize local resources.
5050 (b) The department shall require each local mental health
5151 authority to incorporate jail diversion strategies into the
5252 authority's disease management practices to reduce the involvement
5353 of the criminal justice system in [for] managing adults with the
5454 following disorders as defined by the Diagnostic and Statistical
5555 Manual of Mental Disorders, 5th Edition (DSM-5):
5656 (1) schizophrenia;
5757 (2) [and] bipolar disorder;
5858 (3) post-traumatic stress disorder;
5959 (4) schizoaffective disorder, including bipolar and
6060 depressive types;
6161 (5) anxiety disorder; or
6262 (6) delusional disorder [to reduce the involvement of
6363 those client populations with the criminal justice system].
6464 SECTION 2. This Act takes effect January 1, 2014.
