12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Section 408.124, Labor Code, is amended by | |
14 | 14 | adding Subsection (d) to read as follows: | |
15 | 15 | (d) Notwithstanding Subsections (b) and (c), for | |
16 | 16 | determining the existence and degree of an employee's impairment | |
17 | 17 | related to a lumbar injury, the division shall use the range of | |
18 | 18 | motion model in "Guides to the Evaluation of Permanent Impairment," | |
19 | 19 | Fourth Edition, dated June 1993, published by the American Medical | |
20 | 20 | Association. | |
21 | 21 | SECTION 2. The change in law made by this Act applies only | |
22 | 22 | to an assignment of an impairment rating that is made on or after | |
23 | 23 | the effective date of this Act. An assignment that is made before | |
24 | 24 | the effective date of this Act is governed by the law in effect on | |
25 | 25 | the date the assignment was made, and the former law is continued in | |
26 | 26 | effect for that purpose. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2013. |
