88 AN ACT
99 relating to the determination of the impairment rating of an
1010 employee with a lumbar injury under the workers' compensation
1111 system.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 408.124, Labor Code, is amended by
1414 adding Subsection (d) to read as follows:
1515 (d) Notwithstanding Subsections (b) and (c), for
1616 determining the existence and degree of an employee's impairment
1717 related to a lumbar injury, the division shall use the range of
1818 motion model in "Guides to the Evaluation of Permanent Impairment,"
1919 Fourth Edition, dated June 1993, published by the American Medical
2020 Association.
2121 SECTION 2. The change in law made by this Act applies only
2222 to an assignment of an impairment rating that is made on or after
2323 the effective date of this Act. An assignment that is made before
2424 the effective date of this Act is governed by the law in effect on
2525 the date the assignment was made, and the former law is continued in
2626 effect for that purpose.
2727 SECTION 3. This Act takes effect September 1, 2013.
