83R10035 SCL-D By: Vo H.B. No. 2669 A BILL TO BE ENTITLED AN ACT relating to a release of certain adult stem cell donor information by the Department of Public Safety. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. The heading to Subchapter Q, Chapter 521, Transportation Code, is amended to read as follows: SUBCHAPTER Q. ANATOMICAL GIFTS AND DONATIONS SECTION 2. Subchapter Q, Chapter 521, Transportation Code, is amended by adding Section 521.403 to read as follows: Sec. 521.403. RELEASE OF CERTAIN INFORMATION FOR ADULT STEM CELL DONORS. (a) The department shall provide to each applicant for issuance of an original, renewal, corrected, or duplicate driver's license or personal identification certificate an opportunity for the applicant to consent to the department's release of the applicant's name, most recent address, and telephone number to an adult stem cell bank described by Section 1003.001, Health and Safety Code, and to an entity that provides an adult stem cell donor registry in this state. (b) The written consent for release of information under this section must specify that: (1) the applicant's name, most recent address, and telephone number are covered by the release; (2) the purpose for the release is to facilitate adult stem cell donation; (3) an adult stem cell bank and an adult stem cell donor registry may receive the information covered by the release; and (4) an applicant may withdraw consent to the release by submitting a written notice of withdrawal to the department. (c) An applicant may withdraw consent to the release of information under this section by submitting to the department a written notice of withdrawal. Withdrawal of consent does not affect information disclosed by the department before the date the written withdrawal notice was received by the department. (d) The department by rule shall provide the information covered by the release to an entity that requests the information if the department is satisfied that the requesting entity is an adult stem cell bank described by Section 1003.001, Health and Safety Code, or an entity that provides an adult stem cell donor registry. The department may require that the requesting entity provide evidence that the entity is entitled to receive information under this section and that the entity will use the information received from the department only for adult stem cell donation purposes. SECTION 3. (a) The Department of Public Safety shall adopt the rules necessary to implement Section 521.403, Transportation Code, as added by this Act, not later than January 1, 2014. (b) Section 521.403, Transportation Code, as added by this Act, applies only to an application for an original, renewal, corrected, or duplicate driver's license or personal identification certificate submitted on or after January 1, 2014. SECTION 4. This Act takes effect September 1, 2013.
