99 relating to the permissible noise level of a sound emitted from a
1010 motor vehicle audible warning device.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 547.501(d), Transportation Code, is
1313 amended to read as follows:
1414 (d) A warning device, including a horn, may not emit:
1515 (1) a sound that exceeds a decibel level prescribed by
1616 department rule; or
1717 (2) an unreasonably [loud or] harsh sound or a
1818 whistle.
1919 SECTION 2. The Department of Public Safety shall adopt the
2020 rules to implement Section 547.501(d), Transportation Code, as
2121 amended by this Act, not later than January 1, 2014.
2222 SECTION 3. The changes in law made by this Act in amending
2323 Section 547.501(d), Transportation Code, apply only to an offense
2424 committed on or after the date rules adopted by the department to
2525 implement that subsection take effect. An offense committed before
2626 the date the rules take effect is governed by the law in effect on
2727 the date the offense was committed, and the former law is continued
2828 in effect for that purpose.
2929 SECTION 4. This Act takes effect September 1, 2013.
