9 | 9 | relating to the permissible noise level of a sound emitted from a | |
10 | 10 | motor vehicle audible warning device. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 547.501(d), Transportation Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | (d) A warning device, including a horn, may not emit: | |
15 | 15 | (1) a sound that exceeds a decibel level prescribed by | |
16 | 16 | department rule; or | |
17 | 17 | (2) an unreasonably [loud or] harsh sound or a | |
18 | 18 | whistle. | |
19 | 19 | SECTION 2. The Department of Public Safety shall adopt the | |
20 | 20 | rules to implement Section 547.501(d), Transportation Code, as | |
21 | 21 | amended by this Act, not later than January 1, 2014. | |
22 | 22 | SECTION 3. The changes in law made by this Act in amending | |
23 | 23 | Section 547.501(d), Transportation Code, apply only to an offense | |
24 | 24 | committed on or after the date rules adopted by the department to | |
25 | 25 | implement that subsection take effect. An offense committed before | |
26 | 26 | the date the rules take effect is governed by the law in effect on | |
27 | 27 | the date the offense was committed, and the former law is continued | |
28 | 28 | in effect for that purpose. | |
29 | 29 | SECTION 4. This Act takes effect September 1, 2013. |
