1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 263.153(a) and (c), Local Government
1313 Code, are amended to read as follows:
1414 (a) Except as provided by Subsection (c), the [The]
1515 commissioners court shall publish notice of a sale of surplus or
1616 salvage property in at least one newspaper of general circulation
1717 in the county.
1818 (c) A county that contracts with an auctioneer licensed
1919 under Chapter 1802, Occupations Code, or that authorizes a county
2020 employee in the course and scope of the employee's duties, [who uses
2121 an Internet auction site offering online bidding through the
2222 Internet] to sell surplus or salvage property under this subchapter
2323 through an Internet auction site offering online bidding through
2424 the Internet [having an estimated value of not more than $500] shall
2525 satisfy the notice requirement under this section by posting the
2626 property on the site for at least 10 days [unless the property is
2727 sold before the 10th day].
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2013.
