| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Sections 263.153(a) and (c), Local Government |
|---|
| 13 | 13 | | Code, are amended to read as follows: |
|---|
| 14 | 14 | | (a) Except as provided by Subsection (c), the [The] |

| 15 | 15 | | commissioners court shall publish notice of a sale of surplus or |
|---|
| 16 | 16 | | salvage property in at least one newspaper of general circulation |
|---|
| 17 | 17 | | in the county. |

| 19 | 19 | | under Chapter 1802, Occupations Code, or that authorizes a county |
|---|
| 20 | 20 | | employee in the course and scope of the employee's duties, [who uses |

| 21 | 21 | | an Internet auction site offering online bidding through the |
|---|
| 22 | 22 | | Internet] to sell surplus or salvage property under this subchapter |
|---|
| 23 | 23 | | through an Internet auction site offering online bidding through |
|---|
| 24 | 24 | | the Internet [having an estimated value of not more than $500] shall |
|---|
| 25 | 25 | | satisfy the notice requirement under this section by posting the |
|---|
| 26 | 26 | | property on the site for at least 10 days [unless the property is |
|---|
| 27 | 27 | | sold before the 10th day]. |

| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2013. |
