| 9 | 9 | | relating to the operation of a golf cart or utility vehicle on a |

| 10 | 10 | | public highway in certain counties. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 551.402, Transportation Code, is amended |
|---|
| 13 | 13 | | by amending Subsection (b) and adding Subsection (c) to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | (b) The department may issue license plates for a golf cart |
|---|
| 16 | 16 | | [only] as authorized by a procedure established under Subsection |
|---|
| 17 | 17 | | (c) [Section 504.510]. |
|---|
| 18 | 18 | | (c) The department shall by rule establish a procedure to |
|---|
| 19 | 19 | | issue license plates for a golf cart to be used for operation on a |
|---|
| 20 | 20 | | public highway. |
|---|
| 21 | 21 | | SECTION 2. Section 551.404, Transportation Code, is amended |
|---|
| 22 | 22 | | by amending Subsection (a-1) and adding Subsection (a-2) to read as |
|---|
| 23 | 23 | | follows: |
|---|
| 24 | 24 | | (a-1) In addition to the operation authorized by Section |
|---|
| 25 | 25 | | 551.403, the commissioners court of a county described by |
|---|
| 26 | 26 | | Subsection (a-2) [that borders or contains a portion of the |
|---|
| 27 | 27 | | Guadalupe River and contains a part of a barrier island that borders |
|---|
| 28 | 28 | | the Gulf of Mexico] may allow an operator to operate a golf cart or |
|---|
| 29 | 29 | | utility vehicle on all or part of a public highway that: |
|---|
| 30 | 30 | | (1) is located in the unincorporated area of the |
|---|
| 31 | 31 | | county; and |
|---|
| 32 | 32 | | (2) has a speed limit of not more than 35 miles per |
|---|
| 33 | 33 | | hour. |
|---|
| 34 | 34 | | (a-2) Subsection (a-1) applies only to a county that: |
|---|
| 35 | 35 | | (1) borders or contains a portion of the Guadalupe |
|---|
| 36 | 36 | | River and contains a part of a barrier island that borders the Gulf |
|---|
| 37 | 37 | | of Mexico; or |
|---|
| 38 | 38 | | (2) is adjacent to a county described by Subdivision |
|---|
| 39 | 39 | | (1) and: |
|---|
| 40 | 40 | | (A) has a population of less than 30,000; and |
|---|
| 41 | 41 | | (B) contains a part of a barrier island that |
|---|
| 42 | 42 | | borders the Gulf of Mexico. |
|---|
| 43 | 43 | | SECTION 3. Section 504.510, Transportation Code, is |
|---|
| 44 | 44 | | repealed. |
|---|
| 45 | 45 | | SECTION 4. Not later than December 31, 2013, the Texas |
|---|
| 46 | 46 | | Department of Motor Vehicles shall establish a procedure for the |
|---|
| 47 | 47 | | issuance of license plates for golf carts to be used for operation |
|---|
| 48 | 48 | | on a public highway, as required by Section 551.402(c), |
|---|
| 49 | 49 | | Transportation Code, as added by this Act. |
|---|
| 50 | 50 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 54 | 54 | | Act takes effect September 1, 2013. |
