99 relating to the provision of emergency services in the
1010 Williamson-Travis Counties Water Control and Improvement District
1111 No. 1F.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1414 Code, is amended by adding Chapter 9042 to read as follows:
1515 CHAPTER 9042. WILLIAMSON-TRAVIS COUNTIES WATER CONTROL AND
1616 IMPROVEMENT DISTRICT NO. 1F
1717 Sec. 9042.001. DEFINITION. In this chapter, "district"
1818 means the Williamson-Travis Counties Water Control and Improvement
1919 District No. 1F.
2020 Sec. 9042.002. REMOVAL OF AREA FROM EMERGENCY SERVICES
2121 DISTRICT. (a) This section applies only to:
2222 (1) a municipality with a population of less than
2323 100,000; and
2424 (2) an emergency services district operating under
2525 Chapter 775, Health and Safety Code, in which the district is wholly
2626 or partly located.
2727 (b) If the district enters into a strategic partnership
2828 agreement with a municipality under Section 43.0751, Local
2929 Government Code, that includes the provision of fire-fighting
3030 services as defined by Section 49.351(k), Water Code, and the
3131 district has completed all other procedures necessary for a
3232 limited-purpose annexation by that municipality, an emergency
3333 services district shall disannex the territory of the district to
3434 be served by the municipality under the agreement in accordance
3535 with Subsection (c).
3636 (c) The territory remains part of the emergency services
3737 district until the secretary of the emergency services district
3838 board receives from the district notice that the requirements of
3939 Subsection (b) have been met. On receipt of the notice, the board
4040 shall immediately change its records to show that the district
4141 territory has been disannexed from the emergency services district
4242 and shall cease to provide further services to the residents of that
4343 territory.
4444 (d) Sections 775.022(b), (c), (d), (e), and (f), Health and
4545 Safety Code, apply to a disannexation under this section, as if the
4646 disannexation occurred under the provisions of Section 775.022(a),
4747 Health and Safety Code.
4848 SECTION 2. (a) The legal notice of the intention to
4949 introduce this Act, setting forth the general substance of this
5050 Act, has been published as provided by law, and the notice and a
5151 copy of this Act have been furnished to all persons, agencies,
5252 officials, or entities to which they are required to be furnished
5353 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5454 Government Code.
5555 (b) The governor, one of the required recipients, has
5656 submitted the notice and Act to the Texas Commission on
5757 Environmental Quality.
5858 (c) The Texas Commission on Environmental Quality has filed
5959 its recommendations relating to this Act with the governor, the
6060 lieutenant governor, and the speaker of the house of
6161 representatives within the required time.
6262 (d) All requirements of the constitution and laws of this
6363 state and the rules and procedures of the legislature with respect
6464 to the notice, introduction, and passage of this Act are fulfilled
6565 and accomplished.
6666 SECTION 3. This Act takes effect September 1, 2013.
