9	9	relating to the availability of certain school district financial
10	10	information on districts' Internet websites.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Subchapter A, Chapter 44, Education Code, is
13	13	amended by adding Section 44.0031 to read as follows:
14	14	Sec. 44.0031. ELECTRONIC CHECKING ACCOUNT TRANSACTION
15	15	REGISTER. (a) A school district shall maintain the transaction
16	16	register for the district's checking account in a searchable
17	17	portable document format (PDF) in which the transaction register is
18	18	readily available for purposes of Subsections (d) and (e). Except
19	19	as provided by Subsection (b) or (c), the electronic checking
20	20	account transaction register must include for each check written
21	21	from a district checking account:
22	22	(1) the transaction amount; and
23	23	(2) the name of the payee.
24	24	(a-1) Beginning September 1, 2013, a school district's
25	25	electronic checking account transaction register must contain the
26	26	information required by Subsection (a) for each check dated on or
27	27	after August 1, 2013. This subsection expires September 1, 2014.
28	28	(b) A school district may not include in the district's
29	29	electronic checking account transaction register a check issued to
30	30	a district employee in payment of:
31	31	(1) salary, wages, or an employment stipend; or
32	32	(2) a workers' compensation income benefit, medical
33	33	benefit, death benefit, or burial benefit that is issued by a school
34	34	district operating as a self-insurer under Chapter 504, Labor Code.
35	35	(c) This section does not apply to a checking account
36	36	maintained by a school district or school campus solely for a
37	37	student activity fund.
38	38	(d) A school district shall prominently post at all times on
39	39	the home page of the district's Internet website a direct link to
40	40	the web page on the district's website that contains the district's
41	41	electronic checking account transaction register for viewing and
42	42	downloading by interested persons.
43	43	(e) A school district shall share data from the electronic
44	44	checking account transaction register with any interested person
45	45	who requests the data under Chapter 552, Government Code.
46	46	(f) A school district shall:
47	47	(1) update the electronic checking account
48	48	transaction register not later than the 90th day after the closing
49	49	date of the most recent monthly statement for the checking account;
50	50	and
51	51	(2) maintain each transaction or listing in the
52	52	electronic checking account transaction register on the district's
53	53	Internet website until the second anniversary of the date of the
54	54	transaction or listing.
55	55	(g) A school district with a student enrollment of fewer
56	56	than 500 students in kindergarten through grade 12 is not required
57	57	to comply with this section.
58	58	SECTION 2. This Act takes effect immediately if it receives
59	59	a vote of two-thirds of all the members elected to each house, as
60	60	provided by Section 39, Article III, Texas Constitution. If this
61	61	Act does not receive the vote necessary for immediate effect, this
62	62	Act takes effect September 1, 2013.
