99 AN ACT
1010 relating to the development of a model contract management process
1111 for use with low-risk state procurements.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2262.051(d), Government Code, is amended
1414 to read as follows:
1515 (d) The guide must include model provisions for state agency
1616 contracts. The guide must:
1717 (1) distinguish between essential provisions that a
1818 state agency must include in a contract to protect the interests of
1919 this state and recommended provisions that a state agency may
2020 include in a contract;
2121 (2) recognize the unique contracting needs of an
2222 individual state agency or program and provide sufficient
2323 flexibility to accommodate those needs, consistent with protecting
2424 the interests of this state; [and]
2525 (3) include maximum contract periods under which a new
2626 competitive solicitation is not necessary; and
2727 (4) include the model contract management process
2828 developed under Section 2262.104 and recommendations on the
2929 appropriate use of the model.
3030 SECTION 2. Subchapter C, Chapter 2262, Government Code, is
3131 amended by adding Section 2262.104 to read as follows:
3232 Sec. 2262.104. LOW-RISK CONTRACTS. The contract advisory
3333 team shall identify the types of procurements that pose a low risk
3434 of loss to the state and develop a model contract management process
3535 for use with those procurements.
3636 SECTION 3. This Act takes effect September 1, 2013.
