| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 2262.051(d), Government Code, is amended |
|---|
| 14 | 14 | | to read as follows: |
|---|
| 15 | 15 | | (d) The guide must include model provisions for state agency |
|---|
| 16 | 16 | | contracts. The guide must: |
|---|
| 17 | 17 | | (1) distinguish between essential provisions that a |
|---|
| 18 | 18 | | state agency must include in a contract to protect the interests of |
|---|
| 19 | 19 | | this state and recommended provisions that a state agency may |
|---|
| 20 | 20 | | include in a contract; |
|---|
| 21 | 21 | | (2) recognize the unique contracting needs of an |
|---|
| 22 | 22 | | individual state agency or program and provide sufficient |
|---|
| 23 | 23 | | flexibility to accommodate those needs, consistent with protecting |
|---|
| 24 | 24 | | the interests of this state; [and] |
|---|
| 25 | 25 | | (3) include maximum contract periods under which a new |
|---|
| 26 | 26 | | competitive solicitation is not necessary; and |
|---|
| 27 | 27 | | (4) include the model contract management process |
|---|
| 28 | 28 | | developed under Section 2262.104 and recommendations on the |
|---|
| 29 | 29 | | appropriate use of the model. |

| 30 | 30 | | SECTION 2. Subchapter C, Chapter 2262, Government Code, is |
|---|
| 31 | 31 | | amended by adding Section 2262.104 to read as follows: |
|---|
| 32 | 32 | | Sec. 2262.104. LOW-RISK CONTRACTS. The contract advisory |
|---|
| 33 | 33 | | team shall identify the types of procurements that pose a low risk |
|---|
| 34 | 34 | | of loss to the state and develop a model contract management process |
|---|
| 35 | 35 | | for use with those procurements. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2013. |
