99 relating to duties of the comptroller's office regarding
1010 state-owned intellectual property and commercial equity.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 403, Government Code, is
1313 amended by adding Section 403.0302 to read as follows:
1414 Sec. 403.0302. STATE-OWNED INTELLECTUAL PROPERTY AND
1515 COMMERCIAL EQUITY. (a) In this section:
1616 (1) "Commercial equity" means an ownership interest in
1717 a commercial enterprise.
1818 (2) "Expressive work" means:
1919 (A) a fictional or nonfictional entertainment,
2020 dramatic, literary, or musical work that is a play, book, magazine,
2121 newspaper, musical composition, audiovisual work, radio or
2222 television program, work of art, or work of political or newsworthy
2323 value; or
2424 (B) an advertisement or commercial announcement
2525 of a work described by Paragraph (A).
2626 (3) "Intellectual property" means an intangible asset
2727 that is subject to statutory protection under applicable patent,
2828 copyright, or trademark law. The term includes an invention,
2929 industrial design, identifying mark or symbol, electronic
3030 publication, trade secret, and literary, musical, artistic,
3131 photographic, or film work.
3232 (4) "State agency" has the meaning assigned by Section
3333 403.241.
3434 (b) The comptroller, using existing resources, shall
3535 compile a list of the intellectual property and commercial equity
3636 in which this state has an ownership interest or through its
3737 operations may acquire an ownership interest.
3838 (c) Not later than December 31 of each even-numbered year,
3939 the comptroller shall collect information from each state agency
4040 regarding the intellectual property and commercial equity in which
4141 the agency has an ownership interest or may acquire an ownership
4242 interest. The information submitted by the state agency must
4343 contain:
4444 (1) the total amount the state agency spent to acquire
4545 the ownership interest, including the amount of any grant awarded
4646 or loan granted, and the value of any other operations;
4747 (2) any realized or unrealized gain that has resulted
4848 from the ownership interest; and
4949 (3) the status of the intellectual property or
5050 commercial equity.
5151 (d) For purposes of Subsection (c), an ownership interest
5252 does not include a grant awarded or other assistance provided under
5353 Subchapter B, Chapter 485.
5454 (e) From the information submitted under Subsection (c),
5555 the comptroller shall electronically publish a biennial
5656 comprehensive report detailing the intellectual property and
5757 commercial equity in which the state has an ownership interest.
5858 (f) This section does not apply to an expressive work:
5959 (1) that is created by a person who at the time the
6060 work was created was not employed by or otherwise providing
6161 services to the state related to the work; or
6262 (2) in which the state has no ownership interest.
6363 SECTION 2. Section 2111.002, Government Code, is amended to
6464 read as follows:
6565 Sec. 2111.002. REPORTING. Each state agency shall report
6666 to the lieutenant governor, [and] the speaker of the house of
6767 representatives, and the comptroller any technological innovation
6868 developed by the agency that:
6969 (1) has potential commercial application, is
7070 proprietary, or could be protected under intellectual property
7171 laws; and
7272 (2) was developed:
7373 (A) during the preceding calendar year; or
7474 (B) before the preceding calendar year but was
7575 not previously reported to the lieutenant governor, [and] the
7676 speaker of the house of representatives, and the comptroller.
7777 SECTION 3. This Act takes effect September 1, 2013.
