13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Chapter 323, Local Government Code, is amended |
---|
15 | 15 | | by adding Subchapter D to read as follows: |

16 | 16 | | SUBCHAPTER D. LIBRARY FINES; CIVIL PENALTY |
---|
17 | 17 | | Sec. 323.071. LIBRARY FINES. (a) The commissioners court |
---|
18 | 18 | | by order may establish reasonable fines to be collected by a county |
---|
19 | 19 | | library for lost, damaged, or overdue library property. |
---|
20 | 20 | | (b) The fines shall be deposited in the county free library |
---|
21 | 21 | | fund. |
---|
22 | 22 | | Sec. 323.072. ABUSE OF COUNTY LIBRARY SERVICES. (a) The |
---|
23 | 23 | | commissioners court by order may adopt reasonable regulations that |
---|
24 | 24 | | prohibit a person from abusing library services by intentionally |
---|
25 | 25 | | failing to pay a library fine or return library property. |
---|
26 | 26 | | (b) A person who violates a regulation adopted by the county |
---|
27 | 27 | | under this section is liable to the county for a civil penalty of |
---|
28 | 28 | | not more than $100 for each violation. A county may bring suit in a |
---|
29 | 29 | | district or county court to recover a civil penalty authorized by |
---|
30 | 30 | | this subsection. |
---|
31 | 31 | | SECTION 2. This Act takes effect September 1, 2013. |
