1010 AN ACT
1111 relating to lost, damaged, or overdue county library property;
1212 authorizing fines; authorizing a civil penalty.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Chapter 323, Local Government Code, is amended
1515 by adding Subchapter D to read as follows:
1616 SUBCHAPTER D. LIBRARY FINES; CIVIL PENALTY
1717 Sec. 323.071. LIBRARY FINES. (a) The commissioners court
1818 by order may establish reasonable fines to be collected by a county
1919 library for lost, damaged, or overdue library property.
2020 (b) The fines shall be deposited in the county free library
2121 fund.
2222 Sec. 323.072. ABUSE OF COUNTY LIBRARY SERVICES. (a) The
2323 commissioners court by order may adopt reasonable regulations that
2424 prohibit a person from abusing library services by intentionally
2525 failing to pay a library fine or return library property.
2626 (b) A person who violates a regulation adopted by the county
2727 under this section is liable to the county for a civil penalty of
2828 not more than $100 for each violation. A county may bring suit in a
2929 district or county court to recover a civil penalty authorized by
3030 this subsection.
3131 SECTION 2. This Act takes effect September 1, 2013.
