A BILL TO BE ENTITLED
AN ACT
relating to compliance monitoring by the Texas Department of
Housing and Community Affairs.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 2306.6719, Government Code, is amended
by adding Subsection (c) to read as follows:
(c) The compliance monitoring system shall provide
reasonable opportunities to cure and shall not deem a development
to be in material noncompliance if the owner has corrected all
events of noncompliance within the corrective action period given
by the department.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2013.
