1010 relating to statutory durable powers of attorney.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 752.051, Estates Code, as effective
1313 January 1, 2014, is amended to read as follows:
1414 Sec. 752.051. FORM. The following form is known as a
1515 "statutory durable power of attorney":

1818 SWEEPING. THEY ARE EXPLAINED IN THE DURABLE POWER OF ATTORNEY ACT,
1919 SUBTITLE P, TITLE 2, ESTATES CODE. IF YOU HAVE ANY QUESTIONS ABOUT

137137 Agent's Duties
138138 When you accept the authority granted under this power of
139139 attorney, you establish a "fiduciary" relationship with the
140140 principal. This is a special legal relationship that imposes on you
141141 legal duties that continue until you resign or the power of attorney
142142 is terminated or revoked by the principal or by operation of law. A
143143 fiduciary duty generally includes the duty to:
144144 (1) act in good faith;
145145 (2) do nothing beyond the authority granted in this
146146 power of attorney;
147147 (3) act loyally for the principal's benefit;
148148 (4) avoid conflicts that would impair your ability to
149149 act in the principal's best interest; and
150150 (5) disclose your identity as an agent or attorney in
151151 fact when you act for the principal by writing or printing the name
152152 of the principal and signing your own name as "agent" or "attorney
153153 in fact" in the following manner:

156156 In addition, the Durable Power of Attorney Act (Subtitle P,
157157 Title 2, Estates Code) requires you to:
158158 (1) maintain records of each action taken or decision

162162 (3) if requested by the principal, provide an

166166 (A) the property belonging to the principal that
167167 has come to your knowledge or into your possession;
168168 (B) each action taken or decision made by you as
169169 agent or attorney in fact;
170170 (C) a complete account of receipts,
171171 disbursements, and other actions of you as agent or attorney in fact
172172 that includes the source and nature of each receipt, disbursement,
173173 or action, with receipts of principal and income shown separately;
174174 (D) a listing of all property over which you have
175175 exercised control that includes an adequate description of each
176176 asset and the asset's current value, if known to you;
177177 (E) the cash balance on hand and the name and
178178 location of the depository at which the cash balance is kept;
179179 (F) each known liability;
180180 (G) any other information and facts known to you
181181 as necessary for a full and definite understanding of the exact
182182 condition of the property belonging to the principal; and
183183 (H) all documentation regarding the principal's
184184 property.
185185 Termination of Agent's Authority
186186 You must stop acting on behalf of the principal if you learn
187187 of any event that terminates this power of attorney or your
188188 authority under this power of attorney. An event that terminates
189189 this power of attorney or your authority to act under this power of
190190 attorney includes:
191191 (1) the principal's death;
192192 (2) the principal's revocation of this power of
193193 attorney or your authority;
194194 (3) the occurrence of a termination event stated in
195195 this power of attorney;
196196 (4) if you are married to the principal, the
197197 dissolution of your marriage by court decree of divorce or
198198 annulment;
199199 (5) the appointment and qualification of a permanent
200200 guardian of the principal's estate; or
201201 (6) if ordered by a court, the suspension of this power
202202 of attorney on the appointment and qualification of a temporary
203203 guardian until the date the term of the temporary guardian expires.
204204 Liability of Agent
205205 The authority granted to you under this power of attorney is
206206 specified in the Durable Power of Attorney Act (Subtitle P, Title 2,
207207 Estates Code). If you violate the Durable Power of Attorney Act or
208208 act beyond the authority granted, you may be liable for any damages
209209 caused by the violation or subject to prosecution for
210210 misapplication of property by a fiduciary under Chapter 32 of the
211211 Texas Penal Code.

213213 THE APPOINTMENT, ASSUMES THE FIDUCIARY AND OTHER LEGAL

215215 SECTION 2. Section 752.002, Estates Code, as effective
216216 January 1, 2014, is amended to read as follows:
217217 Sec. 752.002. VALIDITY NOT AFFECTED. A power of attorney is
218218 valid with respect to meeting the requirements for a statutory
219219 durable power of attorney regardless of the fact that:
220220 (1) one or more of the categories of optional powers
221221 listed in the form prescribed by Section 752.051 are not initialed
222222 [struck]; or
223223 (2) the form includes specific limitations on, or
224224 additions to, the powers of the attorney in fact or agent.
225225 SECTION 3. The changes in law made by this Act apply only to
226226 a power of attorney executed on or after the effective date of this
227227 Act. A power of attorney executed before the effective date of this
228228 Act is governed by the law in effect on the date the power of
229229 attorney was executed, and that law is continued in effect for that
230230 purpose.
231231 SECTION 4. This Act takes effect January 1, 2014.
