13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 143.075, Local Government Code, is |
---|
15 | 15 | | amended to read as follows: |
---|
16 | 16 | | Sec. 143.075. MILITARY LEAVE TIME ACCOUNTS. (a) A |
---|
17 | 17 | | municipality shall maintain military leave time accounts for the |
---|
18 | 18 | | fire and police departments and must maintain a separate military |
---|
19 | 19 | | leave time account for each department. |
---|
20 | 20 | | (b) A military leave time account shall benefit a fire |
---|
21 | 21 | | fighter or police officer who: |
---|
22 | 22 | | (1) is a member of the Texas National Guard or the |
---|
23 | 23 | | armed forces reserves of the United States; |
---|
24 | 24 | | (2) was called to active federal military duty while |
---|
25 | 25 | | serving as a fire fighter or police officer for the municipality; |
---|
26 | 26 | | and |
---|
27 | 27 | | (3) has served on active duty for a period of 3 [12] |
---|
28 | 28 | | continuous months or longer[; and |
---|
29 | 29 | | [(4) has exhausted the balance of the person's |
---|
30 | 30 | | vacation, holiday, and compensatory leave time accumulations]. |
---|
31 | 31 | | (c) A fire fighter or police officer may donate any amount |
---|
32 | 32 | | of accumulated vacation, holiday, sick, or compensatory leave time |
---|
33 | 33 | | to the military leave time account in that fire fighter's or police |
---|
34 | 34 | | officer's department to help provide salary continuation for fire |
---|
35 | 35 | | fighters or police officers who qualify as eligible beneficiaries |
---|
36 | 36 | | of the account under Subsection (b). A fire fighter or police |
---|
37 | 37 | | officer who wishes to donate time to an account under this section |
---|
38 | 38 | | must authorize the donation in writing on a form provided by the |
---|
39 | 39 | | fire or police department and approved by the municipality. |
---|
40 | 40 | | (d) A municipality shall equally distribute the leave time |
---|
41 | 41 | | donated to a military leave time account among all fire fighters or |
---|
42 | 42 | | police officers who are eligible beneficiaries of that account. |
---|
43 | 43 | | The municipality shall credit and debit the applicable military |
---|
44 | 44 | | leave time account on an hourly basis regardless of the cash value |
---|
45 | 45 | | of the time donated or used. |
---|
46 | 46 | | SECTION 2. This Act takes effect immediately if it receives |
---|
47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
---|
48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
---|
50 | 50 | | Act takes effect September 1, 2013. |
