| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 501.0234(e), Transportation Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (e) The [department shall develop a form or electronic | |
| 13 | 13 | process in which the] purchaser of a motor vehicle may notify the | |
| 14 | 14 | seller, at the time of purchase, of [shall designate] the | |
| 15 | 15 | purchaser's choice as set out in Section 501.023 as the recipient of | |
| 16 | 16 | all taxes, fees, and other revenue collected as a result of the | |
| 17 | 17 | transaction, which the tax assessor-collector is authorized by law | |
| 18 | 18 | to retain. [A seller shall make that form or electronic process | |
| 19 | 19 | available to the purchaser of a vehicle at the time of purchase.] | |
| 20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2013. |
