11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter A, Chapter 215, Local Government |
---|
13 | 13 | | Code, is amended by adding Section 215.005 to read as follows: |
---|
14 | 14 | | Sec. 215.005. STATE LICENSE HOLDERS. (a) In this section: |
---|
15 | 15 | | (1) "State license holder" means a person who: |
---|
16 | 16 | | (A) is required by state law to obtain a license, |
---|
17 | 17 | | permit, registration, certificate, or other evidence of authority |
---|
18 | 18 | | from a state licensing authority to practice an occupation, conduct |
---|
19 | 19 | | a business, or exercise certain other rights; and |
---|
20 | 20 | | (B) is subject to regulation by the licensing |
---|
21 | 21 | | authority. |
---|
22 | 22 | | (2) "State licensing authority" means a state agency, |
---|
23 | 23 | | department, board, or commission. |
---|
24 | 24 | | (b) Notwithstanding any other law, the governing body of a |
---|
25 | 25 | | municipality may not adopt or enforce an ordinance, rule, or |
---|
26 | 26 | | regulation that establishes requirements for, imposes restrictions |
---|
27 | 27 | | on, or otherwise regulates the activity of a state license holder |
---|
28 | 28 | | within the municipality or the municipality's extraterritorial |
---|
29 | 29 | | jurisdiction, except as provided by Subsection (c). |
---|
30 | 30 | | (c) A municipality may adopt or enforce: |
---|
31 | 31 | | (1) a zoning ordinance under Chapter 211; |
---|
32 | 32 | | (2) a commercial building regulation under Chapter |
---|
33 | 33 | | 214; |
---|
34 | 34 | | (3) a sexually oriented business regulation; |
---|
35 | 35 | | (4) a fire code; |
---|
36 | 36 | | (5) an electrical code; |
---|
37 | 37 | | (6) a plumbing code; or |
---|
38 | 38 | | (7) an ordinance or regulation concerning wages, |
---|
39 | 39 | | benefits, workplace safety, or working conditions. |
---|
40 | 40 | | (d) A municipal ordinance, rule, or regulation that |
---|
41 | 41 | | violates this section is void and unenforceable. |
---|
42 | 42 | | SECTION 2. This Act takes effect immediately if it receives |
---|
43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
---|
44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
---|
46 | 46 | | Act takes effect September 1, 2013. |
