| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Subchapter Z, Chapter 271, Local Government |
|---|
| 15 | 15 | | Code, is amended by adding Section 271.909 to read as follows: |
|---|
| 16 | 16 | | Sec. 271.909. PROJECT DESIGN AND CONSTRUCTION REQUIREMENTS |
|---|
| 17 | 17 | | APPLICABLE TO CERTAIN AGENCIES, INSTRUMENTALITIES, AND AGREEMENTS. |
|---|
| 18 | 18 | | (a) In this section, "governmental entity" means a county, |
|---|
| 19 | 19 | | municipality, district, or other political subdivision of this |
|---|
| 20 | 20 | | state. |
|---|
| 21 | 21 | | (b) The same state laws related to the design and |
|---|
| 22 | 22 | | construction of projects, including the procurement of design and |
|---|
| 23 | 23 | | construction services, that apply to a governmental entity apply to |
|---|
| 24 | 24 | | an agency or instrumentality of the governmental entity, an |
|---|
| 25 | 25 | | economic development corporation created by the governmental |
|---|
| 26 | 26 | | entity under Subtitle C1, Title 12, or an alliance, agreement, |
|---|
| 27 | 27 | | partnership, or agency created between the governmental entity and |
|---|
| 28 | 28 | | one or more other governmental entities. |
|---|
| 29 | 29 | | SECTION 2. The changes in law made by this Act affecting |
|---|
| 30 | 30 | | contract requirements apply only to a contract for which an entity |
|---|
| 31 | 31 | | first advertises or otherwise solicits bids, proposals, offers, or |
|---|
| 32 | 32 | | qualifications or makes a similar solicitation on or after the |
|---|
| 33 | 33 | | effective date of this Act. A contract for which an entity first |
|---|
| 34 | 34 | | advertises or otherwise solicits bids, proposals, offers, or |
|---|
| 35 | 35 | | qualifications or makes a similar solicitation before the effective |
|---|
| 36 | 36 | | date of this Act is governed by the law in effect on the date the |
|---|
| 37 | 37 | | advertisement or solicitation is made, and that law is continued in |
|---|
| 38 | 38 | | effect for that purpose. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2013. |
