88 relating to the regulation of firefighters and fire departments by
99 the Texas Commission on Fire Protection.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 419, Government Code, is
1212 amended by adding Section 419.0323 to read as follows:
1313 Sec. 419.0323. RESTRICTIONS ON CERTAIN CERTIFICATE
1414 HOLDERS. A person who is a municipal employee may not perform a
1515 duty that is classified as a wildland fire-fighting duty, including
1616 conducting a prescribed burn, unless the person is a permanent,
1717 full-time fire department employee regularly assigned to perform
1818 one or more duties listed under Section 419.021(3)(C), regardless
1919 of whether the person holds a certificate issued by the commission
2020 under this chapter.
2121 SECTION 2. Section 419.909, Government Code, is amended by
2222 adding Subsection (d) to read as follows:
2323 (d) The commission shall adopt and implement rules relating
2424 to the application of this section to a fire department.
2525 SECTION 3. The Texas Commission on Fire Protection shall
2626 adopt the rules required under Section 419.909, Government Code, as
2727 amended by this Act, not later than January 1, 2014.
2828 SECTION 4. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2013.
