66 AN ACT
77 relating to allowing a county commissioners court to contract with
88 an attorney to enforce subdivision platting requirements in certain
99 counties that are economically distressed or that are located near
1010 the international border of this state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 232.037, Local Government Code, is
1313 amended by adding Subsection (e) to read as follows:
1414 (e) The commissioners court by order may contract with a
1515 licensed attorney to take any action necessary in a court of
1616 competent jurisdiction on behalf of the state or on behalf of the
1717 residents to:
1818 (1) enjoin the violation or threatened violation of
1919 applicable model rules adopted under Section 16.343, Water Code;
2020 (2) enjoin the violation or threatened violation of a
2121 requirement of this subchapter or a rule adopted by the
2222 commissioners court under this subchapter;
2323 (3) recover civil penalties, attorney's fees,
2424 litigation costs, and investigation costs; and
2525 (4) require platting as required by this subchapter.
2626 SECTION 2. Section 232.080, Local Government Code, is
2727 amended by adding Subsection (d) to read as follows:
2828 (d) The commissioners court by order may contract with a
2929 licensed attorney to take any action necessary in a court of
3030 competent jurisdiction on behalf of the state or on behalf of the
3131 residents to:
3232 (1) enjoin the violation or threatened violation of
3333 applicable model rules adopted under Section 16.343, Water Code;
3434 (2) enjoin the violation or threatened violation of a
3535 requirement of this subchapter or a rule adopted by the
3636 commissioners court under this subchapter;
3737 (3) recover civil penalties, attorney's fees,
3838 litigation costs, and investigation costs; and
3939 (4) require platting as required by this subchapter.
4040 SECTION 3. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2013.
