 A BILL TO BE ENTITLED
 AN ACT
 relating to the creation of a fee on registration of a vehicle to
 fund transportation projects.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter G, Chapter 502, Transportation Code,
 is amended by adding Section 502.360 to read as follows:
 Sec. 502.360.  ADDITIONAL FEE FOR TRANSPORTATION PROJECTS.
 (a)  In addition to other fees charged for registration of a motor
 vehicle, at the time of application for registration or renewal of
 registration of a motor vehicle, the applicant shall pay an
 additional fee of $50.  Fees collected under this section shall be
 remitted weekly to the department.
 (b)  A motor vehicle that may be registered under this
 chapter without payment of a registration fee may be registered
 without payment of the additional fee under this section.
 (c)  Fees collected under this section shall be deposited to
 the credit of the Texas Mobility Fund.
 (d)  The Texas Transportation Commission shall distribute
 the proceeds of obligations issued under Section 201.943 that are
 secured by revenue from fees collected under this section to:
 (1)  each metropolitan planning organization; and
 (2)  each county that is not in the area of a
 metropolitan planning organization.
 (e)  The Texas Transportation Commission shall allocate the
 proceeds of obligations distributed under Subsection (d) according
 to the fee revenue collected in the area of each metropolitan
 planning organization and each county that receives proceeds under
 that subsection.
 (f)  The proceeds of obligations distributed under
 Subsection (d) may be used only for a transportation project:
 (1)  selected by a metropolitan planning organization
 or county to which those proceeds are distributed; and
 (2)  that:
 (A)  relieves congestion;
 (B)  improves safety; or
 (C)  addresses air quality.
 (g)  The proceeds of obligations distributed under
 Subsection (d) may not be used to fund a toll project defined by
 Section 201.001(b).
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2013.
