55 AN ACT
66 relating to a limited exception to the prohibition on releasing
77 personal information about a juror collected during the jury

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 35.29, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 35.29. PERSONAL INFORMATION ABOUT JURORS. (a) Except
1313 as provided by Subsections (b) and (c), information [Information]
1414 collected by the court or by a prosecuting attorney during the jury
1515 selection process about a person who serves as a juror, including
1616 the juror's home address, home telephone number, social security
1717 number, driver's license number, and other personal information, is
1818 confidential and may not be disclosed by the court, the prosecuting
1919 attorney, the defense counsel, or any court personnel.
2020 (b) On [except on] application by a party in the trial, or on
2121 application by a bona fide member of the news media acting in such
2222 capacity, to the court for the disclosure of information described
2323 by Subsection (a), the court shall, on [in which the person is
2424 serving or did serve as a juror. On] a showing of good cause, [the
2525 court shall] permit disclosure of the information sought.
2626 (c) The defense counsel may disclose information described
2727 by Subsection (a) to successor counsel representing the same
2828 defendant in a proceeding under Article 11.071 without application
2929 to the court or a showing of good cause.
3030 SECTION 2. The change in law made by this Act applies to an
3131 application for a writ of habeas corpus under Article 11.071, Code
3232 of Criminal Procedure, that is pending on the effective date of this
3333 Act or filed on or after that date.
3434 SECTION 3. This Act takes effect September 1, 2013.
