| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article 35.29, Code of Criminal Procedure, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Art. 35.29. PERSONAL INFORMATION ABOUT JURORS. (a) Except |
|---|
| 13 | 13 | | as provided by Subsections (b) and (c), information [Information] |
|---|
| 14 | 14 | | collected by the court or by a prosecuting attorney during the jury |
|---|
| 15 | 15 | | selection process about a person who serves as a juror, including |
|---|
| 16 | 16 | | the juror's home address, home telephone number, social security |
|---|
| 17 | 17 | | number, driver's license number, and other personal information, is |
|---|
| 18 | 18 | | confidential and may not be disclosed by the court, the prosecuting |
|---|
| 19 | 19 | | attorney, the defense counsel, or any court personnel. |
|---|
| 20 | 20 | | (b) On [except on] application by a party in the trial, or on |
|---|
| 21 | 21 | | application by a bona fide member of the news media acting in such |
|---|
| 22 | 22 | | capacity, to the court for the disclosure of information described |
|---|
| 23 | 23 | | by Subsection (a), the court shall, on [in which the person is |
|---|
| 24 | 24 | | serving or did serve as a juror. On] a showing of good cause, [the |
|---|
| 25 | 25 | | court shall] permit disclosure of the information sought. |
|---|
| 26 | 26 | | (c) The defense counsel may disclose information described |
|---|
| 27 | 27 | | by Subsection (a) to successor counsel representing the same |
|---|
| 28 | 28 | | defendant in a proceeding under Article 11.071 without application |
|---|
| 29 | 29 | | to the court or a showing of good cause. |
|---|
| 30 | 30 | | SECTION 2. The change in law made by this Act applies to an |
|---|
| 31 | 31 | | application for a writ of habeas corpus under Article 11.071, Code |
|---|
| 32 | 32 | | of Criminal Procedure, that is pending on the effective date of this |
|---|
| 33 | 33 | | Act or filed on or after that date. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2013. |
