| 11 | 11 | | in certain counties; increasing the civil penalty. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 397.0125(a), Transportation Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | (a) In addition to the penalty provided by Section 397.012, |
|---|
| 16 | 16 | | a person who operates an automotive wrecking and salvage yard in |
|---|
| 17 | 17 | | violation of this chapter is liable for a civil penalty of not less |
|---|
| 18 | 18 | | than $500 or more than $5,000 [$1,000] for each violation. A |
|---|
| 19 | 19 | | separate penalty may be imposed for each day a continuing violation |
|---|
| 20 | 20 | | occurs. |

| 21 | 21 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 22 | 22 | | to a violation of Chapter 397, Transportation Code, that occurs on |
|---|
| 23 | 23 | | or after the effective date of this Act. A violation of that |
|---|
| 24 | 24 | | chapter that occurred before the effective date of this Act is |
|---|
| 25 | 25 | | governed by the law in effect when the violation occurred, and the |
|---|
| 26 | 26 | | former law is continued in effect for that purpose. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2013. |
