99 AN ACT
1010 relating to the regulation of automotive wrecking and salvage yards
1111 in certain counties; increasing the civil penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 397.0125(a), Transportation Code, is
1414 amended to read as follows:
1515 (a) In addition to the penalty provided by Section 397.012,
1616 a person who operates an automotive wrecking and salvage yard in
1717 violation of this chapter is liable for a civil penalty of not less
1818 than $500 or more than $5,000 [$1,000] for each violation. A
1919 separate penalty may be imposed for each day a continuing violation
2020 occurs.
2121 SECTION 2. The change in law made by this Act applies only
2222 to a violation of Chapter 397, Transportation Code, that occurs on
2323 or after the effective date of this Act. A violation of that
2424 chapter that occurred before the effective date of this Act is
2525 governed by the law in effect when the violation occurred, and the
2626 former law is continued in effect for that purpose.
2727 SECTION 3. This Act takes effect September 1, 2013.
