| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 245.006, Local Government Code, is | |
| 13 | 13 | amended to read as follows: | |
| 14 | 14 | Sec. 245.006. ENFORCEMENT OF CHAPTER. (a) This chapter may | |
| 15 | 15 | be enforced [only] through mandamus or declaratory or injunctive | |
| 16 | 16 | relief. The attorney general may bring an action to enforce this | |
| 17 | 17 | chapter. | |
| 18 | 18 | (b) A political subdivision's immunity from suit is waived | |
| 19 | 19 | in regard to an action under this chapter. If it is found in a civil | |
| 20 | 20 | action that a political subdivision has violated this chapter, the | |
| 21 | 21 | political subdivision is liable for actual damages and reasonable | |
| 22 | 22 | attorney's fees. | |
| 23 | 23 | SECTION 2. The change in law made by this Act applies only | |
| 24 | 24 | to an action commencing on or after the effective date of this Act. | |
| 25 | 25 | An action commencing before the effective date of this Act is | |
| 26 | 26 | governed by the law in effect on the date the action commenced, and | |
| 27 | 27 | the former law is continued in effect for that purpose. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2013. |
