| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle G, Title 8, Insurance Code, is amended |
|---|
| 11 | 11 | | by adding Chapter 1511 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 1511. CERTAIN HEALTH BENEFIT EXCHANGES NOT AUTHORIZED |
|---|
| 13 | 13 | | Sec. 1511.001. EXCHANGE NOT AUTHORIZED. (a) In this |
|---|
| 14 | 14 | | chapter, "exchange" means an American Health Benefit Exchange or |
|---|
| 15 | 15 | | Small Business Health Options Program (SHOP) Exchange described by |
|---|
| 16 | 16 | | the Patient Protection and Affordable Care Act (42 U.S.C. Section |
|---|
| 17 | 17 | | 18031). |
|---|
| 18 | 18 | | (b) Notwithstanding any other law, this state or any agency |
|---|
| 19 | 19 | | of this state, or a municipality or other political subdivision of |
|---|
| 20 | 20 | | this state, including a department, bureau, board, commission, |
|---|
| 21 | 21 | | office, agency, or council, or a public institution of higher |
|---|
| 22 | 22 | | education, may not take measures to implement, establish, or |
|---|
| 23 | 23 | | maintain, or contract with a person or entity to implement, |
|---|
| 24 | 24 | | establish, or maintain, an exchange described by Subsection (a). |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2013. |
