 A BILL TO BE ENTITLED
 AN ACT
 relating to changing the amount of the application fee for a
 certificate of registration as a private professional guardian.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 ARTICLE 1. CHANGES TO TEXAS PROBATE CODE
 SECTION 1.01.  Section 697(b), Texas Probate Code, is
 amended to read as follows:
 (b)  The application must be accompanied by a nonrefundable
 fee of $40 [set by the clerk in an amount necessary] to cover the
 cost of administering this section.
 SECTION 1.02.  Section 51.607, Government Code, does not
 apply to the change in the amount of a fee made by Section 1.01 of
 this article.
 SECTION 1.03.  The change in law made by this article applies
 only to a fee that becomes payable on or after the effective date of
 this Act. A fee that becomes payable before the effective date of
 this Act is governed by the law in effect when the fee became
 payable, and the former law is continued in effect for that purpose.
 ARTICLE 2. CHANGES TO ESTATES CODE
 SECTION 2.01.  Section 1104.303(b), Estates Code, as
 effective January 1, 2014, is amended to read as follows:
 (b)  The application must be:
 (1)  made to the clerk of the county having venue of the
 proceeding for the appointment of a guardian; and
 (2)  accompanied by a nonrefundable fee of $40 [set by
 the clerk in an amount necessary] to cover the cost of administering
 this subchapter.
 SECTION 2.02.  Section 697(b), Texas Probate Code, as
 amended by Article 1 of this Act, is repealed.
 SECTION 2.03.  Section 51.607, Government Code, does not
 apply to the change in the amount of a fee made by Section 2.01 of
 this article.
 SECTION 2.04.  This article takes effect January 1, 2014.
 ARTICLE 3. EFFECTIVE DATE
 SECTION 3.01.  Except as otherwise provided by this Act,
 this Act takes effect immediately if it receives a vote of
 two-thirds of all the members elected to each house, as provided by
 Section 39, Article III, Texas Constitution. If this Act does not
 receive the vote necessary for immediate effect, this Act takes
 effect September 1, 2013.
