| 7 | 7 | | relating to motor vehicle registration requirements for active duty |

| 8 | 8 | | military personnel stationed in or assigned to another state or |
|---|
| 9 | 9 | | nation. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Subchapter C, Chapter 502, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 502.0901 to read as follows: |
|---|
| 13 | 13 | | Sec. 502.0901. TEMPORARY EXEMPTION FOR VEHICLES OF CERTAIN |
|---|
| 14 | 14 | | MILITARY PERSONNEL. Section 502.040(a) does not apply to the |
|---|
| 15 | 15 | | renewal of registration by a person who: |
|---|
| 16 | 16 | | (1) is a resident of this state; |
|---|
| 17 | 17 | | (2) is on active duty in the armed forces of the United |
|---|
| 18 | 18 | | States; and |
|---|
| 19 | 19 | | (3) is stationed in or assigned to another state or |
|---|
| 20 | 20 | | nation under military orders on the date the person's registration |
|---|
| 21 | 21 | | renewal becomes due. |
|---|
| 22 | 22 | | SECTION 2. Section 683.077(a), Transportation Code, is |
|---|
| 23 | 23 | | amended to read as follows: |
|---|
| 24 | 24 | | (a) Procedures adopted under Section 683.074 or 683.0765 |
|---|
| 25 | 25 | | may not apply to a vehicle or vehicle part: |
|---|
| 26 | 26 | | (1) that is completely enclosed in a building in a |
|---|
| 27 | 27 | | lawful manner and is not visible from the street or other public or |
|---|
| 28 | 28 | | private property; [or] |
|---|
| 29 | 29 | | (2) that is stored or parked in a lawful manner on |
|---|
| 30 | 30 | | private property in connection with the business of a licensed |
|---|
| 31 | 31 | | vehicle dealer or junkyard, or that is an antique or special |
|---|
| 32 | 32 | | interest vehicle stored by a motor vehicle collector on the |
|---|
| 33 | 33 | | collector's property, if the vehicle or part and the outdoor |
|---|
| 34 | 34 | | storage area, if any, are: |
|---|
| 35 | 35 | | (A) maintained in an orderly manner; |
|---|
| 36 | 36 | | (B) not a health hazard; and |
|---|
| 37 | 37 | | (C) screened from ordinary public view by |
|---|
| 38 | 38 | | appropriate means, including a fence, rapidly growing trees, or |
|---|
| 39 | 39 | | shrubbery; or |
|---|
| 40 | 40 | | (3) that is: |
|---|
| 41 | 41 | | (A) stored or parked in a lawful manner on |
|---|
| 42 | 42 | | private property; and |
|---|
| 43 | 43 | | (B) temporarily exempt from registration renewal |
|---|
| 44 | 44 | | requirements under Section 502.0901. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2013. |
