13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 344.051, Local Government Code, is |
---|
15 | 15 | | amended by adding Subsection (a-1) to read as follows: |
---|
16 | 16 | | (a-1) The governing body of a municipality may propose the |
---|
17 | 17 | | creation of a fire control, prevention, and emergency medical |
---|
18 | 18 | | services district under this chapter if the municipality: |
---|
19 | 19 | | (1) has a population of 5,000 or more and less than |
---|
20 | 20 | | 25,000; and |
---|
21 | 21 | | (2) is located in a county with a population of 750,000 |
---|
22 | 22 | | or more: |
---|
23 | 23 | | (A) in which all or part of a municipality with a |
---|
24 | 24 | | population of one million or more is located; and |
---|
25 | 25 | | (B) that is adjacent to a county with a |
---|
26 | 26 | | population of two million or more. |
---|
27 | 27 | | SECTION 2. This Act takes effect September 1, 2013. |
