77 relating to standards for recycling or reusing computer and
88 television equipment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 361.964(b), Health and Safety Code, is
1111 amended to read as follows:
1212 (b) For the purposes of recycling, reusing, or otherwise
1313 disposing of collected computer equipment, a manufacturer must:
1414 (1) follow the standards established under
1515 "Responsible Recycling Practices for Use in Accredited
1616 Certification Programs for Electronic Recyclers" or "e-Stewards
1717 Standard for Responsible Recycling and Reuse of Electronic
1818 Equipment" or an equivalent independently audited certification
1919 standard for electronics recycling; or
2020 (2) use a recycler that has a current certification
2121 indicating the recycler complies with the standards described by
2222 Subdivision (1) [The commission shall adopt as standards for
2323 recycling or reuse of computer equipment in this state the
2424 standards provided by "Electronics Recycling Operating Practices"
2525 as approved by the board of directors of the Institute of Scrap
2626 Recycling Industries, Inc., April 25, 2006, or other standards from
2727 a comparable nationally recognized organization].
2828 SECTION 2. Section 361.982(b), Health and Safety Code, is
2929 amended to read as follows:
3030 (b) A person who is engaged in the business of recycling
3131 covered television equipment in this state shall:
3232 (1) register with the commission and certify that the
3333 person is in compliance with the standards described by [adopted
3434 under] Section 361.990;
3535 (2) on or before January 31 of each year renew the
3636 registration with the commission and certify the person's continued
3737 compliance with the standards described by [adopted under] Section
3838 361.990;
3939 (3) recycle all covered television equipment accepted
4040 for recycling in accordance with the standards adopted under
4141 Section 361.990;
4242 (4) maintain a written log recording the weight of all
4343 covered television equipment received by the person and the
4444 disposition of that equipment; and
4545 (5) annually report to the commission the total weight
4646 of covered television equipment received and recycled by the person
4747 in the preceding 12 months.
4848 SECTION 3. Section 361.990(b), Health and Safety Code, is
4949 amended to read as follows:
5050 (b) For the purposes of recycling, reusing, or otherwise
5151 disposing of collected covered television equipment, a
5252 manufacturer must:
5353 (1) follow the standards established under
5454 "Responsible Recycling Practices for Use in Accredited
5555 Certification Programs for Electronic Recyclers" or "e-Stewards
5656 Standard for Responsible Recycling and Reuse of Electronic
5757 Equipment" or an equivalent independently audited certification
5858 standard for electronics recycling; or
5959 (2) use a recycler that has a current certification
6060 indicating the recycler complies with the standards described by
6161 Subdivision (1) [The commission shall adopt as standards for
6262 recycling or reuse of covered television equipment in this state
6363 the standards provided by "Electronics Recycling Operating
6464 Practices" as approved by the board of directors of the Institute of
6565 Scrap Recycling Industries, Incorporated, April 25, 2006, or other
6666 standards from a comparable nationally recognized organization].
6767 SECTION 4. This Act takes effect September 1, 2013.
