7	7	relating to standards for recycling or reusing computer and
8	8	television equipment.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 361.964(b), Health and Safety Code, is
11	11	amended to read as follows:
12	12	(b) For the purposes of recycling, reusing, or otherwise
13	13	disposing of collected computer equipment, a manufacturer must:
14	14	(1) follow the standards established under
15	15	"Responsible Recycling Practices for Use in Accredited
16	16	Certification Programs for Electronic Recyclers" or "e-Stewards
17	17	Standard for Responsible Recycling and Reuse of Electronic
18	18	Equipment" or an equivalent independently audited certification
19	19	standard for electronics recycling; or
20	20	(2) use a recycler that has a current certification
21	21	indicating the recycler complies with the standards described by
22	22	Subdivision (1) [The commission shall adopt as standards for
23	23	recycling or reuse of computer equipment in this state the
24	24	standards provided by "Electronics Recycling Operating Practices"
25	25	as approved by the board of directors of the Institute of Scrap
26	26	Recycling Industries, Inc., April 25, 2006, or other standards from
27	27	a comparable nationally recognized organization].
28	28	SECTION 2. Section 361.982(b), Health and Safety Code, is
29	29	amended to read as follows:
30	30	(b) A person who is engaged in the business of recycling
31	31	covered television equipment in this state shall:
32	32	(1) register with the commission and certify that the
33	33	person is in compliance with the standards described by [adopted
34	34	under] Section 361.990;
35	35	(2) on or before January 31 of each year renew the
36	36	registration with the commission and certify the person's continued
37	37	compliance with the standards described by [adopted under] Section
38	38	361.990;
39	39	(3) recycle all covered television equipment accepted
40	40	for recycling in accordance with the standards adopted under
41	41	Section 361.990;
42	42	(4) maintain a written log recording the weight of all
43	43	covered television equipment received by the person and the
44	44	disposition of that equipment; and
45	45	(5) annually report to the commission the total weight
46	46	of covered television equipment received and recycled by the person
47	47	in the preceding 12 months.
48	48	SECTION 3. Section 361.990(b), Health and Safety Code, is
49	49	amended to read as follows:
50	50	(b) For the purposes of recycling, reusing, or otherwise
51	51	disposing of collected covered television equipment, a
52	52	manufacturer must:
53	53	(1) follow the standards established under
54	54	"Responsible Recycling Practices for Use in Accredited
55	55	Certification Programs for Electronic Recyclers" or "e-Stewards
56	56	Standard for Responsible Recycling and Reuse of Electronic
57	57	Equipment" or an equivalent independently audited certification
58	58	standard for electronics recycling; or
59	59	(2) use a recycler that has a current certification
60	60	indicating the recycler complies with the standards described by
61	61	Subdivision (1) [The commission shall adopt as standards for
62	62	recycling or reuse of covered television equipment in this state
63	63	the standards provided by "Electronics Recycling Operating
64	64	Practices" as approved by the board of directors of the Institute of
65	65	Scrap Recycling Industries, Incorporated, April 25, 2006, or other
66	66	standards from a comparable nationally recognized organization].
67	67	SECTION 4. This Act takes effect September 1, 2013.
