| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 251.057(b), Transportation Code, is | |
| 12 | 12 | amended to read as follows: | |
| 13 | 13 | (b) This section does not apply to: | |
| 14 | 14 | (1) a road to a cemetery, unless a property owner whose | |
| 15 | 15 | property adjoins the road enclosed with a fence under Subsection | |
| 16 | 16 | (a) files notice with the county clerk of the county in which the | |
| 17 | 17 | road is located that the owner agrees to provide reasonable access | |
| 18 | 18 | to the cemetery in accordance with Section 711.041, Health and | |
| 19 | 19 | Safety Code; or | |
| 20 | 20 | (2) an access road that is reasonably necessary to | |
| 21 | 21 | reach adjoining real property. | |
| 22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2013. |
