99 relating to financial coaches for economically disadvantaged
1010 persons.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 14, Finance Code, is
1313 amended by adding Section 14.1021 to read as follows:
1414 Sec. 14.1021. CERTIFICATION PROGRAM FOR FINANCIAL COACHES.
1515 (a) In this section, "charitable organization" means a nonprofit
1616 corporation that:
1717 (1) is located in this state;
1818 (2) is exempt from federal income tax under Section
1919 501(a) of the Internal Revenue Code of 1986 by being listed as an
2020 exempt organization in Section 501(c)(3) of that code; and
2121 (3) provides services to economically disadvantaged
2222 individuals and families.
2323 (b) The office shall establish and operate a voluntary
2424 certification program for persons serving as financial coaches for
2525 clients of charitable organizations.
2626 (c) The finance commission by rule shall adopt forms,
2727 criteria, and procedures for issuing certificates to financial
2828 coaches under this section.
2929 (d) The criteria for the program must include training and
3030 educational materials to be determined by the finance commission.
3131 (e) The securities commissioner may issue a no-action
3232 letter to a financial coach issued a certificate under this section
3333 who, without compensation, provides to an economically
3434 disadvantaged individual assistance with the individual's
3535 enrollment in any fund or plan established under Subchapter G or H,
3636 Chapter 54, Education Code. The State Securities Board shall adopt
3737 rules to implement this subsection.
3838 SECTION 2. This Act takes effect September 1, 2013.
