66 AN ACT
77 relating to training, certification, and accreditation provided or
88 regulated by the Texas Veterans Commission.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 434.038(d) and (e), Government Code,
1111 are amended to read as follows:
1212 (d) The commission shall develop standard course materials,
1313 training curriculum, and examinations to be used for county service
1414 officer certification and United States Department of Veterans
1515 Affairs accreditation. [The members of the commission must approve
1616 the course materials, training curriculum, and examinations before
1717 the commission may distribute the materials and administer
1818 examinations.]
1919 (e) The commission shall:
2020 (1) maintain course materials and examinations in a
2121 central location and provide county service offices and commission
2222 field staff with access to the course materials on the commission's
2323 Internet website;
2424 (2) regularly update course materials, training
2525 curriculum, and examinations after consulting with:
2626 (A) the United States Department of Veterans
2727 Affairs to ensure the course materials, training curriculum, and
2828 examinations are accurate and meet applicable United States
2929 Department of Veterans Affairs requirements; and
3030 (B) accredited county service officers to ensure
3131 the materials, training curriculum, and examinations include
3232 issues developing at the county level; [and]
3333 (3) develop a training handbook containing
3434 instruction and case studies addressing:
3535 (A) general assistance techniques, including how
3636 to provide general information regarding state and federal benefits
3737 and referrals for other services and to other agencies, and general
3838 information regarding state and federal benefits;
3939 (B) basic counseling approaches for assisting
4040 veterans, their family members, and other eligible dependents
4141 filing benefit claims;
4242 (C) basic information on United States
4343 Department of Veterans Affairs processes and procedures, including
4444 how to accurately complete claims and appeals forms and how to
4545 support claims;
4646 (D) methods of collecting required documentation
4747 and developing claims and appeals;
4848 (E) methods of documenting progress and updating
4949 a veteran's, a veteran's family member's, or another eligible
5050 dependent's case information;
5151 (F) methods of assisting veterans, their family
5252 members, or other eligible dependents in pursuing appeals,
5353 including offering case knowledge in appeals hearings; and
5454 (G) methods of representing veterans, their
5555 family members, or other eligible dependents during appeals
5656 hearings; and
5757 (4) coordinate with the Department of State Health
5858 Services to incorporate a suicide prevention component as part of
5959 the accreditation training and examination.
6060 SECTION 2. This Act takes effect September 1, 2013.
