A BILL TO BE ENTITLED
AN ACT
relating to expunging certain notices of federal tax lien.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 14.004, Property Code, is amended by
adding Subsections (f) and (g) to read as follows:
(f) A person may request a federal tax lien on real property
be expunged from the real property records of the county in which
the property is located by filing with the secretary of state a
letter making the request that includes:
(1) a copy of the release of federal tax lien and
notice of withdrawal of the federal tax lien; and
(2) a designation of the county clerk to be notified of
the request.
(g) On receipt of a request filed under Subsection (f), the
secretary of state shall:
(1) send to the county clerk designated in the request
a letter:
(A) indicating, with a citation to Subsection (f)
and this subsection, that the person has requested that a notice of
federal lien be expunged; and
(B) directing the clerk to expunge the lien from
the property records of the county; and
(2) provide to the person a certified copy of the
letter sent to the county clerk.
SECTION 2. This Act takes effect September 1, 2013.
