11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter A, Chapter 33, Human Resources Code, |
---|
13 | 13 | | is amended by adding Section 33.038 to read as follows: |

14 | 14 | | Sec. 33.038. RULES CONCERNING UNUSED SUPPLEMENTAL |
---|
15 | 15 | | NUTRITION ASSISTANCE PROGRAM BENEFITS. The executive commissioner |
---|
16 | 16 | | shall adopt rules to prevent the excessive accumulation by |
---|
17 | 17 | | recipients of unused benefits under the supplemental nutrition |
---|
18 | 18 | | assistance program. The commission shall consider adopting rules |
---|
19 | 19 | | under this section that: |
---|
20 | 20 | | (1) limit the amount of money that may accumulate in an |
---|
21 | 21 | | electronic benefits transfer account at any one time; and |
---|
22 | 22 | | (2) require the investigation of any recipient who |
---|
23 | 23 | | maintains an excessively high balance of benefits in the |
---|
24 | 24 | | recipient's electronic benefits transfer account. |
---|
25 | 25 | | SECTION 2. If before implementing any provision of this Act |
---|
26 | 26 | | a state agency determines that a waiver or authorization from a |
---|
27 | 27 | | federal agency is necessary for implementation of that provision, |
---|
28 | 28 | | the agency affected by the provision shall request the waiver or |
---|
29 | 29 | | authorization and may delay implementing that provision until the |
---|
30 | 30 | | waiver or authorization is granted. |
---|
31 | 31 | | SECTION 3. This Act takes effect September 1, 2013. |
