| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Article 35.29, Code of Criminal Procedure, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | Art. 35.29. PERSONAL INFORMATION ABOUT JURORS. (a) |
|---|
| 15 | 15 | | Information collected by the court or by a prosecuting attorney |
|---|
| 16 | 16 | | during the jury selection process about a person who serves as a |
|---|
| 17 | 17 | | juror, including the juror's home address, home telephone number, |
|---|
| 18 | 18 | | social security number, driver's license number, and other personal |
|---|
| 19 | 19 | | information, is confidential and may not be disclosed by the court, |
|---|
| 20 | 20 | | the prosecuting attorney, [the defense] counsel representing the |
|---|
| 21 | 21 | | defendant at trial or in a postconviction proceeding, or any court |
|---|
| 22 | 22 | | personnel except as otherwise provided by this article. |
|---|
| 23 | 23 | | (b) Information described by Subsection (a) may be |
|---|
| 24 | 24 | | disclosed to [on application by] a party in the trial or [on |
|---|
| 25 | 25 | | application by] a bona fide member of the news media acting in such |
|---|
| 26 | 26 | | capacity. The [to the court in which the person is serving or did |
|---|
| 27 | 27 | | serve as a juror. On a showing of good cause, the] court shall |
|---|
| 28 | 28 | | permit disclosure of the information only after an application for |
|---|
| 29 | 29 | | the information is made and good cause for receiving the |
|---|
| 30 | 30 | | information is shown [sought]. |
|---|
| 31 | 31 | | (c) On a written request, the court shall disclose the |
|---|
| 32 | 32 | | information described by Subsection (a) that was collected by the |
|---|
| 33 | 33 | | court, including providing copies of any juror summons, to counsel |
|---|
| 34 | 34 | | representing the defendant in a postconviction proceeding. A |
|---|
| 35 | 35 | | showing of good cause is not required for a disclosure under this |
|---|
| 36 | 36 | | subsection. This subsection does not authorize the disclosure of |
|---|
| 37 | 37 | | information described by Subsection (a) that was collected by a |
|---|
| 38 | 38 | | prosecuting attorney. |
|---|
| 39 | 39 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 40 | 40 | | to a jury selected on or after the effective date of this Act. A |
|---|
| 41 | 41 | | jury selected before the effective date of this Act is governed by |
|---|
| 42 | 42 | | the law in effect on the date the jury was selected, and the former |
|---|
| 43 | 43 | | law is continued in effect for that purpose. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2013. |
