99 relating to access to personal information about jurors in a
1010 criminal trial.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 35.29, Code of Criminal Procedure, is
1313 amended to read as follows:
1414 Art. 35.29. PERSONAL INFORMATION ABOUT JURORS. (a)
1515 Information collected by the court or by a prosecuting attorney
1616 during the jury selection process about a person who serves as a
1717 juror, including the juror's home address, home telephone number,
1818 social security number, driver's license number, and other personal
1919 information, is confidential and may not be disclosed by the court,
2020 the prosecuting attorney, [the defense] counsel representing the
2121 defendant at trial or in a postconviction proceeding, or any court
2222 personnel except as otherwise provided by this article.
2323 (b) Information described by Subsection (a) may be
2424 disclosed to [on application by] a party in the trial or [on
2525 application by] a bona fide member of the news media acting in such
2626 capacity. The [to the court in which the person is serving or did
2727 serve as a juror. On a showing of good cause, the] court shall
2828 permit disclosure of the information only after an application for
2929 the information is made and good cause for receiving the
3030 information is shown [sought].
3131 (c) On a written request, the court shall disclose the
3232 information described by Subsection (a) that was collected by the
3333 court, including providing copies of any juror summons, to counsel
3434 representing the defendant in a postconviction proceeding. A
3535 showing of good cause is not required for a disclosure under this
3636 subsection. This subsection does not authorize the disclosure of
3737 information described by Subsection (a) that was collected by a
3838 prosecuting attorney.
3939 SECTION 2. The change in law made by this Act applies only
4040 to a jury selected on or after the effective date of this Act. A
4141 jury selected before the effective date of this Act is governed by
4242 the law in effect on the date the jury was selected, and the former
4343 law is continued in effect for that purpose.
4444 SECTION 3. This Act takes effect September 1, 2013.
