88 AN ACT
99 relating to the provision of and funding for certain primary health
1010 care services; repealing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 31.002(a)(1), (3), and (4), Health and
1313 Safety Code, are amended to read as follows:
1414 (1) "Facility" includes an entity providing primary [a
1515 hospital, ambulatory surgical center, public health clinic,
1616 birthing center, outpatient clinic, and community] health care
1717 services [center].
1818 (3) "Other benefit" means a benefit, other than a
1919 benefit provided under this chapter, to which an individual is
2020 entitled for payment of the costs of primary health care services,
2121 including benefits available from:
2222 (A) an insurance policy, group health plan, or
2323 prepaid medical care plan;
2424 (B) Title XVIII, [or] XIX, or XXI of the Social
2525 Security Act (42 U.S.C. Section 1395 et seq., [or] Section 1396 et
2626 seq., or Section 1397aa et seq.); or
2727 (C) [the Veterans Administration;
2828 [(D) the Civilian Health and Medical Program of
2929 the Uniformed Services;
3030 [(E) workers' compensation or any other
3131 compulsory employers' insurance program;
3232 [(F)] a public program created by federal or
3333 state law, or by an ordinance or rule of a municipality or political
3434 subdivision of the state, excluding benefits created by the
3535 establishment of a municipal or county hospital, a joint
3636 municipal-county hospital, a county hospital authority, a hospital
3737 district, or the facilities of a publicly supported medical
3838 school[; or
3939 [(G) a cause of action for medical, facility, or
4040 medical transportation expenses, or a settlement or judgment based
4141 on the cause of action, if the expenses are related to the need for
4242 services provided under this chapter].
4343 (4) "Primary health care services" may include
4444 [includes]:
4545 (A) a health service related to family, internal,
4646 pediatric, obstetric, or gynecological medicine that is provided by
4747 a physician, physician assistant, or advanced practice registered
4848 nurse [diagnosis and treatment];
4949 (B) diagnostic laboratory and radiological
5050 services;
5151 (C) emergency medical services;
5252 (D) [(C)] family planning services;
5353 (E) [(D)] preventive health services, including:
5454 (i) prenatal and perinatal services;
5555 (ii) appropriate cancer screening;
5656 (iii) well-child services;
5757 (iv) immunizations against diseases that are
5858 preventable by vaccines;
5959 (v) screenings for elevated blood levels,
6060 communicable diseases, and cholesterol levels;
6161 (vi) pediatric eye, ear, and dental
6262 screenings to determine the need for vision and hearing correction
6363 and dental care; and
6464 (vii) preventive dental services;
6565 (F) [(E)] health education;
6666 (G) [(F) laboratory, X-ray, nuclear medicine, or
6767 other appropriate diagnostic services;
6868 [(G) nutrition services;
6969 [(H) health screening;
7070 [(I) home health care;
7171 [(J) dental care;
7272 [(K) transportation;
7373 [(L)] prescription drugs and devices and durable
7474 supplies, as appropriate;
7575 [(M) environmental health services;
7676 [(N) podiatry services;] and
7777 (H) integrated mental health [(O) social]
7878 services.
7979 SECTION 2. Sections 31.003(c), (d), (e), (f), and (g),
8080 Health and Safety Code, are amended to read as follows:
8181 (c) The department [If budgetary limitations exist, the
8282 board by rule] shall establish a system of priorities that includes
8383 factors relating to the types of services provided, to the extent
8484 possible the statewide coverage of the services, and the
8585 [geographic areas covered, or classes of] individuals eligible for
8686 services.
8787 (d) The department [board] shall adopt rules under
8888 Subsection (c) relating to the services provided, to the extent
8989 possible the statewide coverage of the services, [geographic areas
9090 covered] and the [classes of] individuals eligible for services
9191 [according to a statewide determination of the need for services].
9292 (e) The department [board] shall adopt rules under
9393 Subsection (c) relating to the types of services provided according
9494 to the set of service priorities established under this subsection.
9595 Initial service priorities shall focus on the funding of, provision
9696 of, and access to:
9797 (1) health services related to family, internal,
9898 pediatric, obstetric, or gynecological medicine that is provided by
9999 a physician, physician assistant, or advanced practice registered
100100 nurse [diagnosis and treatment];
101101 (2) emergency medical services;
102102 (3) family planning services;
103103 (4) preventive health services, including
104104 immunizations;
105105 (5) health education; and
106106 (6) laboratory, X-ray, [nuclear medicine,] or other
107107 appropriate diagnostic services.
108108 (f) Except as limited by this section, the department shall
109109 develop an integrated framework for the equitable provision of
110110 services throughout the state and shall use existing public and
111111 private health[, transportation, and education] resources.
112112 (g) The department shall ensure that an approved service
113113 provider makes every reasonable effort to collect appropriate
114114 reimbursement for its costs in providing primary health care
115115 services to persons who are entitled to receive other benefits
116116 [board should require that the services provided under this chapter
117117 be reserved to the greatest extent possible for low-income
118118 individuals who are not eligible for similar services through any
119119 other publicly funded program].
120120 SECTION 3. Section 31.012(a), Health and Safety Code, is
121121 amended to read as follows:
122122 (a) The department [board] may authorize [charge fees for
123123 the services provided directly by the department or through]
124124 approved providers to charge a reasonable copayment for services
125125 provided in accordance with Subchapter D, Chapter 12.
126126 SECTION 4. This Act takes effect September 1, 2013.
